relationships, payment of social and health insurance contributions in the private sector."},"content":{"rendered":"<p>All taxpayers who will hire new employees must declare them at least one calendar day prior to the start of work, in accordance with Article 119 of the Law. <a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2020\/09\/Ligj-Nr.9920-dat\u00eb-19.05.2008-P\u00ebr-pro\u00e7edurat-tatimore-n\u00eb-Republik\u00ebn-e-Shqip\u00ebris\u00eb-i-ndryshuar.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">No. 9920, dated 05\/19\/2008<\/a> \u201cFor tax procedures in the Republic of Albania,\u201d as amended.<\/p>\n\n\n\n<p>Regarding the calculation of mandatory contributions, based on the Decision <a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2022\/09\/VKM-Nr.-77-date-28.1.2015-_Per-kontributet-e-detyrueshme-dhe-perfitimet-nga-sistemi-i-sigurimeve-shoqerore-dhe-sigurimi-i-kujdesit-shendetesor_-ndryshuar_.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">no. 77, dated 28.01.2015 <\/a>\u201cFor mandatory contributions and benefits from the social security system and health insurance,\u201d as amended for these categories:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Mandatory contributions for employees on a fixed-term employment contract, lasting more <strong>87 hours later <\/strong>in months, to be:<ul><li>for social security, 23.3%of gross salary, according to the payslip, where the employer's share shall be 13.9% and the employee's share 9.4% , but not less than the minimum wage and not more than the maximum wage, as determined in this decision, for the purpose of calculating social contributions;<\/li><li>for the provision of healthcare, 3.4%of gross salary, according to the payslip, where the employer's part is 1.7% and the employee's part is 1.7%, but not less than the minimum wage determined by decision, for the purpose of calculating healthcare insurance contributions.<\/li><\/ul><\/li><\/ol>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\" start=\"2\"><li>Mandatory contributions for employees on a fixed-term employment contract, lasting more <strong>more than 87 hours <\/strong>in months, to be:<ul><li>for social security, 24.5%of gross salary, according to the payroll, where the employer's portion shall be 15.0% and the employee's portion 9.5% , but not less than the minimum wage and not more than the maximum wage, determined in this decision, for the purpose of calculating social contributions;<\/li><li>p\u00ebr sigurimin e kujdesit sh\u00ebndet\u00ebsor, 3.4% t\u00eb pag\u00ebs bruto, sipas list\u00ebpages\u00ebs, ku pjesa e pun\u00ebdh\u00ebn\u00ebsit t\u00eb jet\u00eb 1.7% dhe pjesa e t\u00eb pun\u00ebsuarit 1.7%, por jo m\u00eb pak se paga minimale, e p\u00ebrcaktuar n\u00eb k\u00ebt\u00eb vendim, p\u00ebr efekt t\u00eb llogaritjes s\u00eb kontributeve t\u00eb sigurimit t\u00eb kujdesit sh\u00ebndet\u00ebsor.<\/li><\/ul><\/li><\/ol>\n\n\n\n<p>The minimum wage for the purpose of calculating social security and health insurance contributions is <strong>32,000 lek\u00eb\/month.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>In no case does current legislation provide for the hiring of employees on probation.<\/p><\/blockquote><\/figure>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\"><li>The mandatory contribution for vocational or technical school students, and university students, for their scheduled internship period shall be:<\/li><\/ol>\n\n\n\n<p>The mandatory contribution for occupational accidents and diseases shall be 0.3% of the minimum gross wage, equal to 66 (sixty-six) lek\u00eb per month.<\/p>\n\n\n\n<p>The contributions are paid by the entity where the internship is carried out and for the period specified in the contract concluded between it and the responsible institution, or by the responsible institution.<\/p>\n\n\n\n<p>P\u00ebr sa m\u00eb lart, \u00ebsht\u00eb detyrim i tatimpaguesit p\u00ebrfshirja n\u00eb skem\u00ebn e sigurimeve shoq\u00ebrore dhe sh\u00ebndet\u00ebsore e student\u00ebve, t\u00eb cil\u00ebt pun\u00ebsohen n\u00eb tatimpagues q\u00eb ushtrojn\u00eb aktivitet ekonomik.<\/p>\n\n\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>Students are treated the same as all employees with an employment contract, lasting less than 87 hours per month or more than 87 hours of work per month, as explained above.<\/p><\/blockquote><\/figure>\n\n\n\n<p>If, from the verification and inspection carried out by the Tax Administration, it results that the taxpayer has not declared every employee, in addition to the obligation to pay the amount of tax liabilities and social and health insurance contributions, then they will be penalized.<\/p>\n\n\n\n<p>If it is a large business taxpayer, the penalty is calculated at 200,000 (two hundred thousand) lek\u00eb, and if it is a small business taxpayer, then the penalty is 50,000 (fifty thousand) lek\u00eb.<\/p>\n\n\n\n<p>Source: <a
