P\u00ebr q\u00ebllimet e zbatimit t\u00eb k\u00ebsaj Marr\u00ebveshjeje:<\/p>\n\n\n\n<p>a) termi \u201cShqip\u00ebria\u201d n\u00ebnkupton Republik\u00ebn e Shqip\u00ebris\u00eb; termi \u201cItalia\u201d n\u00ebnkupton Republik\u00ebn e Italis\u00eb;<\/p>\n\n\n\n<p>b) termi \u201clegjislacion\u201d n\u00ebnkupton rregulloret aktuale ose t\u00eb ardhshme t\u00eb secilit shtet kontraktues q\u00eb kan\u00eb si objekt skemat e sigurimeve shoq\u00ebrore q\u00eb tregohen n\u00eb nenin 2 t\u00eb k\u00ebsaj Marr\u00ebveshjeje;<\/p>\n\n\n\n<p>c) termi \u201cAutoritet Kompetent\u201d n\u00ebnkupton, p\u00ebr sa i p\u00ebrket Shqip\u00ebris\u00eb, ministria p\u00ebrgjegj\u00ebse p\u00ebr sigurimet shoq\u00ebrore dhe p\u00ebr sa i p\u00ebrket Italis\u00eb, Ministria e Pun\u00ebs dhe Politikave Sociale;<\/p>\n\n\n\n<p>d) termi \u201cInstitucion kompetent\u201d n\u00ebnkupton institucionin n\u00eb t\u00eb cilin \u00ebsht\u00eb regjistruar subjekti i interesuar n\u00eb momentin e k\u00ebrkes\u00ebs p\u00ebr p\u00ebrfitime ose institucionin ndaj t\u00eb cilit i interesuari ka t\u00eb drejt\u00eb p\u00ebr p\u00ebrfitime ose q\u00eb do t\u2019i lindte kjo e drejt\u00eb n\u00ebse ai ose an\u00ebtar\u00ebt e familjes s\u00eb tij do t\u00eb banonin n\u00eb territorin e Shtetit Kontraktues n\u00eb t\u00eb cilin ndodhet ky institucion;<\/p>\n\n\n\n<p>e) termi \u201cOrgan nd\u00ebrlidh\u00ebs\u201d n\u00ebnkupton zyrat, t\u00eb cilat do t\u00eb ngarkohen nga autoritetet kompetente p\u00ebr t\u00eb komunikuar drejtp\u00ebrdrejt midis tyre dhe p\u00ebr t\u00eb vepruar si nd\u00ebrmjet\u00ebs me institucionet kompetente t\u00eb dy shteteve kontraktuese, me q\u00ebllimin e ofrimit t\u00eb p\u00ebrfitimeve q\u00eb parashikohen n\u00eb k\u00ebt\u00eb Marr\u00ebveshje;<\/p>\n\n\n\n<p>f) termi \u201cpunonj\u00ebs\u201d n\u00ebnkupton personat q\u00eb kryejn\u00eb veprimtari pune dhe q\u00eb jan\u00eb t\u00eb siguruar ose t\u00eb pranuar n\u00eb p\u00ebrfitimet e legjislacioneve t\u00eb p\u00ebrmendura n\u00eb nenin 2 t\u00eb k\u00ebsaj Marr\u00ebveshjeje;<\/p>\n\n\n\n<p>g) termi \u201can\u00ebtar\u00eb t\u00eb familjes\u201d n\u00ebnkupton ata q\u00eb p\u00ebrcaktohen ose njihen si t\u00eb till\u00eb nga legjislacioni n\u00eb fuqi;<\/p>\n\n\n\n<p>h) termi \u201ct\u00eb mbijetuar\u201d n\u00ebnkupton ata q\u00eb p\u00ebrcaktohen ose njihen si t\u00eb till\u00eb nga legjislacioni n\u00eb&nbsp;fuqi;<\/p>\n\n\n\n<p>i) termi \u201cq\u00ebndrim\u201d n\u00ebnkupton q\u00ebndrimin p\u00ebr nj\u00eb koh\u00ebzgjatje t\u00eb shkurt\u00ebr;<\/p>\n\n\n\n<p>l) termi \u201cvendbanim\u201d n\u00ebnkupton vendbanimin e zakonsh\u00ebm;<\/p>\n\n\n\n<p>m) termi \u201cperiudha sigurimi\u201d n\u00ebnkupton periudhat e kontributit dhe\/ose t\u00eb pun\u00ebsimit, t\u00eb cilat jan\u00eb p\u00ebrcaktuar ose jan\u00eb marr\u00eb parasysh si periudha sigurimi nga legjislacioni n\u00eb fuqi n\u00eb lidhje me to;<\/p>\n\n\n\n<p>n) termi \u201cperiudha ekuivalente\u201d n\u00ebnkupton periudhat e asimiluara n\u00eb periudhat e sigurimit nga legjislacioni i zbatuesh\u00ebm n\u00eb fuqi n\u00eb lidhje me to;<\/p>\n\n\n\n<p>o) termi \u201cp\u00ebrfitime\u201d n\u00ebnkupton p\u00ebrfitimet n\u00eb para t\u00eb parashikuara nga legjislacioni i nj\u00ebr\u00ebs apo tjetr\u00ebs Pal\u00eb.<\/p>\n\n\n\n<p>2. \u00c7do shprehje apo term tjet\u00ebr i p\u00ebrdorur n\u00eb k\u00ebt\u00eb Marr\u00ebveshje ka kuptimin q\u00eb i jepet nga legjislacioni i zbatuesh\u00ebm n\u00eb fuqi n\u00eb lidhje me t\u00eb.<\/p>\n\n\n\n<p>Neni 2<\/p>\n\n\n\n<p><strong>Fusha e zbatimit material<\/strong><\/p>\n\n\n\n<p>1. Kjo Marr\u00ebveshje zbatohet p\u00ebr legjislacionet q\u00eb lidhen me:<\/p>\n\n\n\n<p>N\u00eb Shqip\u00ebri:<\/p>\n\n\n\n<p>a) sigurimin p\u00ebr pleq\u00ebrin\u00eb, invaliditetin dhe pensionin familjar (pasjetuesit);<\/p>\n\n\n\n<p>b) sigurimin p\u00ebr p\u00ebrfitimin p\u00ebr s\u00ebmundjet dhe barr\u00eblindja;<\/p>\n\n\n\n<p>c) sigurimin e papun\u00ebsis\u00eb.&nbsp;<\/p>\n\n\n\n<p>N\u00eb Itali:<\/p>\n\n\n\n<p>a) sigurimin e p\u00ebrgjithsh\u00ebm t\u00eb detyruesh\u00ebm p\u00ebr pension invaliditeti, pleq\u00ebrie dhe familjar t\u00eb punonj\u00ebsve t\u00eb pun\u00ebsuar, trajtimin e posa\u00e7\u00ebm t\u00eb punonj\u00ebsve t\u00eb vet\u00ebpun\u00ebsuar (artizan\u00eb, tregtar\u00eb, fermer\u00eb) dhe trajtimin e ndar\u00eb t\u00eb k\u00ebtij sigurimi tim p\u00ebrgjithsh\u00ebm t\u00eb detyruesh\u00ebm;<\/p>\n\n\n\n<p>b) sigurimin p\u00ebr p\u00ebrfitimin p\u00ebr s\u00ebmundjet, ku p\u00ebrfshihen edhe tuberkulozi dhe barr\u00eb lindja;<\/p>\n\n\n\n<p>c) sigurimin e papun\u00ebsis\u00eb;<\/p>\n\n\n\n<p>d) skemat e posa\u00e7me z\u00ebvend\u00ebsuese dhe t\u00eb ve\u00e7anta t\u00eb sigurimit, t\u00eb krijuara p\u00ebr kategori t\u00eb caktuara punonj\u00ebsish, mbasi ato u referohen sh\u00ebrbimeve ose rrisqeve q\u00eb mbulohen nga legjislacionet e treguara n\u00eb shkronjat e m\u00ebparshme.<\/p>\n\n\n\n<p>2. Kjo Marr\u00ebveshje do t\u00eb zbatohet nj\u00eblloj n\u00eb rast se rregullore t\u00eb m\u00ebpasme modifikojn\u00eb legjislacionet e p\u00ebrmendura n\u00eb&nbsp;pik\u00ebn&nbsp;1.<\/p>\n\n\n\n<p>3. Kjo Marr\u00ebveshje do t\u00eb zbatohet, gjithashtu, edhe p\u00ebr ligjet e nj\u00eb Shteti kontraktues q\u00eb do t\u2019i zgjerojn\u00eb skemat ekzistuese p\u00ebr kategori t\u00eb reja punonj\u00ebsish ose q\u00eb do t\u2019i krijojn\u00eb skema t\u00eb reja t\u00eb sigurimeve shoq\u00ebrore, me kusht q\u00eb Qeveria e shtetit tjet\u00ebr kontraktues t\u00eb mos njoftoj\u00eb kund\u00ebrshtimin e saj ndaj Qeveris\u00eb s\u00eb shtetit t\u00eb par\u00eb brenda tre muajve nga data e komunikimit zyrtar t\u00eb k\u00ebtyre zgjerimeve.<\/p>\n\n\n\n<p>4. Kjo Marr\u00ebveshje nuk zbatohet p\u00ebr ligjet e dy Shteteve Kontraktuese n\u00eb lidhje me pensionet sociale dhe p\u00ebrfitimet e tjera jokontributdh\u00ebn\u00ebse t\u00eb paguara nga fondet publike, si dhe p\u00ebr shtimin e trajtimit minimal, me p\u00ebrjashtim t\u00eb dispozitave t\u00eb nenit 16.<\/p>\n\n\n\n<p>5. Dispozitat e parashikuara nga kjo Marr\u00ebveshje do t\u00eb zbatohen n\u00eb p\u00ebrputhje me legjislacionet p\u00ebrkat\u00ebse komb\u00ebtare dhe duke respektuar detyrimet nd\u00ebrkomb\u00ebtare dhe, p\u00ebr sa i p\u00ebrket Italis\u00eb, detyrimet q\u00eb rrjedhin nga t\u00eb qen\u00ebt an\u00ebtare e Bashkimit Evropian.<\/p>\n\n\n\n<p>Neni 3<\/p>\n\n\n\n<p><strong>Fusha e zbatimit personal<\/strong><\/p>\n\n\n\n<p>1. Kjo Marr\u00ebveshje zbatohet p\u00ebr personat q\u00eb jan\u00eb ose kan\u00eb qen\u00eb subjekt i legjislacionit t\u00eb nj\u00ebrit ose t\u00eb t\u00eb dyja shteteve kontraktuese, si edhe p\u00ebr an\u00ebtar\u00ebt e familjes dhe pasjetuesit e tyre t\u00eb mbetur.<\/p>\n\n\n\n<p>2. Kjo Marr\u00ebveshje zbatohet edhe p\u00ebr refugjat\u00ebt, n\u00eb baz\u00eb t\u00eb Konvent\u00ebs s\u00eb 28 korrikut 1951 n\u00eb lidhje me Statusin e Refugjat\u00ebve dhe protokollin e saj t\u00eb 31 janarit 1967, si edhe p\u00ebr personat pa shtet\u00ebsi, n\u00eb baz\u00eb t\u00eb Konvent\u00ebs s\u00eb 28 shtatorit 1954 n\u00eb lidhje me statusin e personave pa shtet\u00ebsi q\u00eb banojn\u00eb n\u00eb territorin e nj\u00eb shteti kontraktues, t\u00eb cil\u00ebt jan\u00eb ose kan\u00eb qen\u00eb subjekt i legjislacionit t\u00eb nj\u00ebrit ose t\u00eb t\u00eb dyja shteteve kontraktuese, si edhe an\u00ebtar\u00ebve t\u00eb familjes dhe pasjetuesit e tyre.<\/p>\n\n\n\n<p>Neni 4<\/p>\n\n\n\n<p><strong>Trajtim i barabart\u00eb<\/strong><\/p>\n\n\n\n<p>Me p\u00ebrjashtim t\u00eb rasteve kur parashikohet ndryshe n\u00eb k\u00ebt\u00eb Marr\u00ebveshje, personat ndaj t\u00eb cil\u00ebve zbatohet kjo Marr\u00ebveshje do t\u00eb g\u00ebzojn\u00eb t\u00eb nj\u00ebjtat p\u00ebrfitime dhe do t\u2019u n\u00ebnshtrohen t\u00eb nj\u00ebjtave detyrime, sipas legjislacionit t\u00eb secilit shtet kontraktues, me t\u00eb nj\u00ebjtat kushte si qytetar\u00ebt e atij shteti. P\u00ebr sa i p\u00ebrket Italis\u00eb, do t\u2019u sigurohet trajtim i barabart\u00eb edhe qytetar\u00ebve t\u00eb Bashkimit Evropian.<\/p>\n\n\n\n<p>PJESA II<\/p>\n\n\n\n<p><strong>Dispozitat p\u00ebr legjislacionin n\u00eb fuqi<\/strong><\/p>\n\n\n\n<p>Neni 5<\/p>\n\n\n\n<p><strong>Dispozita t\u00eb p\u00ebrgjithshme<\/strong><strong><\/strong><\/p>\n\n\n\n<p>P\u00ebrve\u00e7 rasteve kur parashikohet ndryshe n\u00eb nenet e m\u00ebposhtme 6 dhe 7, punonj\u00ebsit ndaj t\u00eb cil\u00ebve zbatohen dispozitat e k\u00ebsaj Marr\u00ebveshjeje i n\u00ebnshtrohen legjislacionit t\u00eb Shtetit kontraktues n\u00eb t\u00eb cilin ata zhvillojn\u00eb veprimtarit\u00eb e pun\u00ebs s\u00eb tyre.<\/p>\n\n\n\n<p>Neni 6<\/p>\n\n\n\n<p><strong>Dispozita t\u00eb ve\u00e7anta<\/strong><\/p>\n\n\n\n<p>Dispozitat e p\u00ebrcaktuara nga neni 5 k\u00ebrkojn\u00eb p\u00ebrjashtimet e m\u00ebposhtme:<\/p>\n\n\n\n<p>1. Nj\u00eb punonj\u00ebs i pun\u00ebsuar n\u00eb nj\u00eb nd\u00ebrmarrjeje t\u00eb krijuar n\u00eb nj\u00eb nga shtetet kontraktuese, i cili \u00ebsht\u00eb d\u00ebrguar n\u00eb territorin e shtetit tjet\u00ebr, do t\u00eb mbetet subjekt i legjislacionit t\u00eb shtetit t\u00eb par\u00eb, me kusht q\u00eb pun\u00ebsimi i tij n\u00eb shtetin tjet\u00ebr t\u00eb mos e kaloj\u00eb periudh\u00ebn prej 24 muajsh.<\/p>\n\n\n\n<p>2. Nj\u00eb person q\u00eb kryen zakonisht nj\u00eb veprimtari autonome n\u00eb territorin e nj\u00ebrit prej dy shteteve kontraktuese dhe q\u00eb shkon p\u00ebr t\u00eb ushtruar nj\u00eb veprimtari t\u00eb till\u00eb n\u00eb territorin e shtetit tjet\u00ebr p\u00ebr nj\u00eb periudh\u00eb t\u00eb kufizuar kohe, vazhdon t\u00eb jet\u00eb i siguruar sipas legjislacionit t\u00eb shtetit t\u00eb par\u00eb, me kusht q\u00eb q\u00ebndrimi i tij n\u00eb shtetin tjet\u00ebr t\u00eb mos e kaloj\u00eb periudh\u00ebn prej 24 muajsh.<\/p>\n\n\n\n<p>3. Personeli udh\u00ebtues i shoq\u00ebrive t\u00eb transportit ajror, rrugor ose hekurudhor, i n\u00ebnshtrohet ekskluzivisht legjislacionit t\u00eb shtetit n\u00eb territorin e t\u00eb cilit ndodhet selia e shoq\u00ebris\u00eb.<\/p>\n\n\n\n<p>4. An\u00ebtar\u00ebt e ekuipazhit t\u00eb nj\u00eb anijeje q\u00eb mban flamurin e nj\u00ebrit prej shteteve kontraktuese i n\u00ebnshtrohen legjislacionit t\u00eb shtetit t\u00eb cilit i p\u00ebrket flamuri, punonj\u00ebsit e pun\u00ebsuar p\u00ebr ngarkimin dhe shkarkimin, riparimin ose mbik\u00ebqyrjen e anijeve, nd\u00ebrkoh\u00eb q\u00eb ndodhen n\u00eb nj\u00eb port t\u00eb shtetit tjet\u00ebr kontraktues, i n\u00ebnshtrohen legjislacionit t\u00eb shtetit t\u00eb cilit i p\u00ebrket ai port.<\/p>\n\n\n\n<p>5. Agjent\u00ebt diplomatik\u00eb dhe konsujt e karrier\u00ebs, si edhe personeli administrativ dhe teknik q\u00eb u p\u00ebrkasin misioneve diplomatike dhe konsullore, t\u00eb cil\u00ebt n\u00eb ushtrimin e funksioneve t\u00eb tyre d\u00ebrgohen n\u00eb territorin e shtetit tjet\u00ebr kontraktues, mbeten subjekt, s\u00eb bashku me an\u00ebtar\u00ebt e familjes s\u00eb tyre, i legjislacionit t\u00eb shtetit kontraktues t\u00eb cilit i p\u00ebrket administrata nga e cila ata varen.<\/p>\n\n\n\n<p>6. Punonj\u00ebsit e pun\u00ebsuar nga nj\u00eb administrat\u00eb publike dhe personeli i barasvlersh\u00ebm i nj\u00ebrit prej shteteve kontraktuese, t\u00eb cil\u00ebt n\u00eb ushtrimin e funksioneve t\u00eb tyre, d\u00ebrgohen n\u00eb territorin e shtetit tjet\u00ebr kontraktues, s\u00eb bashku me an\u00ebtar\u00ebt e familjes s\u00eb tyre, mbeten subjekt i legjislacionit t\u00eb shtetit kontraktues t\u00eb cilit i p\u00ebrket administrata nga e cila ata varen.<\/p>\n\n\n\n<p>Neni 7<\/p>\n\n\n\n<p><strong>Dispozita t\u00eb ve\u00e7anta p\u00ebr personelin tjet\u00ebr p\u00ebrve\u00e7 atij q\u00eb u p\u00ebrket p\u00ebrfaq\u00ebsive diplomatike<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Personeli i p\u00ebrfaq\u00ebsive diplomatike dhe konsullore, p\u00ebrve\u00e7 atyre t\u00eb p\u00ebrcaktuara n\u00eb pik\u00ebn 6, t\u00eb nenit 6, si dhe personeli vend\u00ebs n\u00eb sh\u00ebrbimin privat t\u00eb agjent\u00ebve diplomatik\u00eb dhe konsullor\u00eb, ose an\u00ebtar\u00eb t\u00eb tjer\u00eb t\u00eb k\u00ebtyre misioneve diplomatike dhe zyrave konsullore, mund t\u00eb ushtrojn\u00eb opsionin p\u00ebr zbatimin e legjislacionit t\u00eb shtetit d\u00ebrgues, sipas dispozitave t\u00eb Marr\u00ebveshjes Administrative t\u00eb parashikuara nga neni 19, me kusht q\u00eb ata t\u00eb jen\u00eb shtetas t\u00eb atij shteti.<\/p>\n\n\n\n<p>Neni 8<\/p>\n\n\n\n<p><strong>P\u00ebrjashtimet nga nenet 5 dhe 6<\/strong><\/p>\n\n\n\n<p>Autoritetet kompetente t\u00eb dy shteteve kontraktuese ose institucionet e deleguara prej tyre mund t\u00eb parashikojn\u00eb me marr\u00ebveshje t\u00eb p\u00ebrbashk\u00ebta, p\u00ebrjashtime, pavar\u00ebsisht nga dispozitat e neneve 5 dhe 6 t\u00eb k\u00ebsaj Marr\u00ebveshjeje, n\u00eb interes t\u00eb punonj\u00ebsve.<\/p>\n\n\n\n<p>Neni 9<\/p>\n\n\n\n<p><strong>Eksportueshm\u00ebria e p\u00ebrfitimeve n\u00eb para<\/strong><\/p>\n\n\n\n<p>P\u00ebrve\u00e7 rasteve kur parashikohet ndryshe n\u00eb k\u00ebt\u00eb Marr\u00ebveshje, punonj\u00ebsit q\u00eb kan\u00eb t\u00eb drejt\u00eb p\u00ebr p\u00ebrfitime n\u00eb para nga nj\u00ebri shtet kontraktues, do t\u2019i marrin ato mbi baz\u00ebn e nj\u00eb trajtimi t\u00eb barabart\u00eb&nbsp;me shtetasit e atij shteti n\u00eb territorin e shtetit tjet\u00ebr kontraktues ose t\u00eb nj\u00eb shteti t\u00eb tret\u00eb, n\u00eb respektim t\u00eb legjislacionit t\u00eb secilit shtet.<\/p>\n\n\n\n<p>Neni 10<\/p>\n\n\n\n<p><strong>Sigurimi vullnetar<\/strong><strong><\/strong><\/p>\n\n\n\n<p>1. P\u00ebr q\u00ebllimet e pranimit n\u00eb sigurimin vullnetar, n\u00ebse parashikohet nga legjislacioni i nj\u00ebrit prej shteteve kontraktuese, periudhat e sigurimit t\u00eb plot\u00ebsuara sipas legjislacionit t\u00eb atij shteti grumbullohen, n\u00ebse \u00ebsht\u00eb e nevojshme, me periudhat e sigurimit t\u00eb plot\u00ebsuara sipas legjislacionit t\u00eb shtetit tjet\u00ebr kontraktues, me kusht q\u00eb ato t\u00eb mos mbivendosen dhe sipas dispozitave t\u00eb parashikuara nga legjislacioni i secilit shtet.<\/p>\n\n\n\n<p>2. Regjistrimi i nj\u00ebkohsh\u00ebm n\u00eb sigurimin e detyruesh\u00ebm t\u00eb nj\u00eb shteti kontraktues dhe sigurimin vullnetar t\u00eb shtetit tjet\u00ebr lejohet vet\u00ebm n\u00eb rast se nj\u00eb mund\u00ebsi e till\u00eb lejohet nga legjislacioni i k\u00ebtij t\u00eb fundit.<\/p>\n\n\n\n<p>Neni 11<\/p>\n\n\n\n<p><strong>Bashkimi i periudhave<\/strong><\/p>\n\n\n\n<p>P\u00ebr q\u00ebllimet e fitimit, ruajtjes ose rikuperimit t\u00eb s\u00eb drejt\u00ebs p\u00ebr p\u00ebrfitime n\u00eb para, t\u00eb parashikuara nga kjo Marr\u00ebveshje, periudhat e sigurimit ose ato t\u00eb barasvlershme me to, t\u00eb plot\u00ebsuara sipas legjislacionit t\u00eb nj\u00ebrit shtet kontraktues, bashkohen, n\u00ebse \u00ebsht\u00eb e nevojshme, me periudhat e sigurimit ose ato t\u00eb barasvlershme me to, sipas ligjeve t\u00eb shtetit tjet\u00ebr kontraktues, me kusht q\u00eb ato t\u00eb mos mbivendosen.<\/p>\n\n\n\n<p>PJESA III<\/p>\n\n\n\n<p><strong>Dispozita t\u00eb ve\u00e7anta<\/strong><strong><\/strong><\/p>\n\n\n\n<p>KAPITULLI I<\/p>\n\n\n\n<p>PENSIONET<\/p>\n\n\n\n<p>Neni 12<\/p>\n\n\n\n<p><strong>Pensionet q\u00eb paguhen&nbsp;sipas&nbsp;legjislacionit&nbsp;t\u00eb nj\u00ebrit&nbsp;shtet&nbsp;kontraktues (n\u00eb&nbsp;regjim autonom)&nbsp;<\/strong><\/p>\n\n\n\n<p>N\u00ebse nj\u00eb punonj\u00ebs i plot\u00ebson kushtet e p\u00ebrcaktuara nga legjislacioni i nj\u00ebrit shtet kontraktues p\u00ebr t\u00eb&nbsp;fituar t\u00eb drejt\u00ebn e p\u00ebrfitimeve pa pasur nevoj\u00eb t\u00eb p\u00ebrdor\u00eb bashkimin e periudhave t\u00eb sigurimit, sikurse parashikohet n\u00eb nenin 11, institucioni kompetent i atij shteti duhet t\u00eb jap\u00eb shum\u00ebn e p\u00ebrfitimit t\u00eb llogaritur ekskluzivisht n\u00eb baz\u00eb t\u00eb periudhave t\u00eb sigurimit t\u00eb plot\u00ebsuara sipas legjislacionit q\u00eb ai zbaton. Kjo dispozit\u00eb zbatohet edhe n\u00eb rast se i siguruari ka t\u00eb drejt\u00eb, nga shteti tjet\u00ebr kontraktues, p\u00ebr nj\u00eb p\u00ebrfitim t\u00eb llogaritur sipas nenit 13.<\/p>\n\n\n\n<p>Neni 13<\/p>\n\n\n\n<p><strong>Pensionet e paguara sipas legjislacioneve t\u00eb dy shteteve kontraktuese<\/strong><\/p>\n\n\n\n<p><strong>(bashkimi nd\u00ebrkomb\u00ebtar dhe proporcional)<\/strong><\/p>\n\n\n\n<p>1. N\u00ebse nj\u00eb punonj\u00ebs nuk i plot\u00ebson kushtet e parashikuara nga legjislacioni i nj\u00ebrit shtet kontraktues p\u00ebr t\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitime t\u00eb bazuara vet\u00ebm n\u00eb periudhat e sigurimit dhe shumat e barasvlershme t\u00eb plot\u00ebsuara sipas atij legjislacioni, institucioni kompetent i atij shteti do t\u00eb zbatoj\u00eb dispozitat e p\u00ebrcaktuara nga neni 11.<\/p>\n\n\n\n<p>2. N\u00ebse legjislacioni i nj\u00eb shteti kontraktues ia n\u00ebnshtron dh\u00ebnien e p\u00ebrfitimeve kushtit q\u00eb periudhat e sigurimit t\u00eb jen\u00eb plot\u00ebsuar n\u00eb nj\u00eb profesion q\u00eb i n\u00ebnshtrohet nj\u00eb skeme t\u00eb ve\u00e7ant\u00eb, p\u00ebr t\u00eb p\u00ebrcaktuar t\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitime t\u00eb tilla bashkohen vet\u00ebm periudhat e plot\u00ebsuara n\u00eb nj\u00eb skem\u00eb t\u00eb barasvlershme n\u00eb shtetin tjet\u00ebr kontraktues ose, n\u00eb rast se nuk ka, n\u00eb t\u00eb nj\u00ebjtin profesion ose pun\u00eb,&nbsp;edhe n\u00ebse n\u00eb shtetin tjet\u00ebr nuk ekziston nj\u00eb regjim i ve\u00e7ant\u00eb p\u00ebr at\u00eb profesion apo pun\u00eb. N\u00ebse shuma e p\u00ebrgjithshme e k\u00ebtyre periudhave t\u00eb sigurimit nuk lejon fitimin e s\u00eb drejt\u00ebs s\u00eb p\u00ebrfitimeve sipas skem\u00ebs s\u00eb ve\u00e7ant\u00eb, k\u00ebto periudha do t\u00eb p\u00ebrdoren p\u00ebr t\u00eb p\u00ebrcaktuar t\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitime n\u00eb skem\u00ebn e p\u00ebrgjithshme.<\/p>\n\n\n\n<p>3. P\u00ebr q\u00ebllimet e p\u00ebrcaktimit t\u00eb p\u00ebrfitimeve t\u00eb duhura n\u00eb zbatim t\u00eb dispozitave t\u00eb nenit 11,&nbsp;institucioni kompetent i secilit shtet kontraktues do t\u00eb veproj\u00eb si m\u00eb posht\u00eb:<\/p>\n\n\n\n<p>a) p\u00ebrcakton mas\u00ebn teorike t\u00eb p\u00ebrfitimit p\u00ebr t\u00eb cil\u00ebn do t\u00eb kishte t\u00eb drejt\u00eb i interesuari, n\u00ebse t\u00eb gjitha periudhat e bashkuara t\u00eb sigurimit do t\u00eb ishin plot\u00ebsuar sipas legjislacionit t\u00eb tij;<\/p>\n\n\n\n<p>b) p\u00ebrcakton pra shum\u00ebn efektive t\u00eb p\u00ebrfitimit p\u00ebr t\u00eb cilin ka t\u00eb drejt\u00eb i interesuari, duke e ulur shum\u00ebn teorike t\u00eb p\u00ebrmendur n\u00eb pik\u00ebn 1, t\u00eb paragrafit 3, n\u00eb baz\u00eb t\u00eb raportit nd\u00ebrmjet&nbsp;periudhave t\u00eb sigurimit t\u00eb plot\u00ebsuara sipas legjislacionit q\u00eb ai zbaton dhe periudhave t\u00eb sigurimit t\u00eb kryera n\u00eb t\u00eb dyja shtetet kontraktuese;<\/p>\n\n\n\n<p>c) n\u00ebse koh\u00ebzgjatja e p\u00ebrgjithshme e periudhave t\u00eb sigurimit t\u00eb plot\u00ebsuara sipas legjislacionit t\u00eb t\u00eb dyja shteteve kontraktuese e tejkalon koh\u00ebzgjatjen maksimale t\u00eb k\u00ebrkuar nga legjislacioni i nj\u00eb shteti p\u00ebr t\u2019u kualifikuar p\u00ebr nj\u00eb p\u00ebrfitim t\u00eb plot\u00eb, institucioni kompetent do t\u00eb marr\u00eb parasysh k\u00ebt\u00eb koh\u00ebzgjatje maksimale, n\u00eb vend t\u00eb koh\u00ebzgjatjes s\u00eb p\u00ebrgjithshme t\u00eb periudhave&nbsp;n\u00eb fjal\u00eb.<\/p>\n\n\n\n<p>4. N\u00ebse legjislacioni i nj\u00eb shteti kontraktues parashikon q\u00eb p\u00ebrfitimet t\u00eb llogariten n\u00eb lidhje me shum\u00ebn e pagave, t\u00eb t\u00eb ardhurave ose t\u00eb kontributeve, institucioni kompetent i atij shteti do t\u00eb marr\u00eb parasysh vet\u00ebm pagat ose t\u00eb ardhurat e marra, ose kontributet e paguara, n\u00eb p\u00ebrputhje me legjislacionin q\u00eb ai zbaton.<\/p>\n\n\n\n<p>Neni 14<\/p>\n\n\n\n<p><strong>Periudha sigurimi m\u00eb pak se nj\u00eb vit<\/strong><\/p>\n\n\n\n<p>Pavar\u00ebsisht nga sa parashikohet nga dispozitat e nenit 13, n\u00ebse koh\u00ebzgjatja e p\u00ebrgjithshme e periudhave t\u00eb sigurimit t\u00eb plot\u00ebsuara sipas legjislacionit t\u00eb nj\u00eb shteti kontraktues nuk arrin t\u00eb pakt\u00ebn nj\u00eb vit dhe n\u00ebse, duke marr\u00eb parasysh vet\u00ebm k\u00ebto periudha, nuk lind e drejta p\u00ebr p\u00ebrfitime sipas atij legjislacioni, institucioni i k\u00ebtij shteti nuk \u00ebsht\u00eb i detyruar t\u00eb paguaj\u00eb p\u00ebrfitime p\u00ebr k\u00ebto periudha. Megjithat\u00eb, k\u00ebto periudha sigurimi merren parasysh nga institucioni kompetent i shtetit tjet\u00ebr kontraktues, si p\u00ebr q\u00ebllimin e fitimit t\u00eb s\u00eb drejt\u00ebs p\u00ebr p\u00ebrfitime sipas legjislacionit t\u00eb atij shteti, ashtu edhe p\u00ebr llogaritjen e tyre.<\/p>\n\n\n\n<p>Neni 15<\/p>\n\n\n\n<p><strong>Pensionet n\u00eb rast se personi nuk i plot\u00ebson nj\u00ebkoh\u00ebsisht kushtet e p\u00ebrcaktuara nga ligjet e dyja shteteve kontraktuese<\/strong><\/p>\n\n\n\n<p>N\u00eb qoft\u00eb se nj\u00eb punonj\u00ebs, edhe duke marr\u00eb parasysh bashkimin e periudhave t\u00eb sigurimit q\u00eb p\u00ebrmendet n\u00eb nenin 11, nuk plot\u00ebson n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb kushtet e k\u00ebrkuara nga ligjet e t\u00eb dyja shteteve kontraktuese, e drejta e tij e pensionit p\u00ebrcaktohet n\u00eb lidhje me secilin legjislacion, pasi t\u00eb plot\u00ebsohen k\u00ebto kushte.<\/p>\n\n\n\n<p>Neni 16<\/p>\n\n\n\n<p><strong>Pensionet minimale<\/strong><\/p>\n\n\n\n<p>1. Secili nga shtetet kontraktuese, n\u00ebse plot\u00ebsohen kushtet e parashikuara nga legjislacioni i tij, do t\u2019i shtoj\u00eb trajtimit minimal p\u00ebrfitimet, e drejta e t\u00eb cilave arrihet n\u00eb baz\u00eb t\u00eb nenit 11, vet\u00ebm n\u00ebse p\u00ebrfituesi banon n\u00eb territorin e tij.<\/p>\n\n\n\n<p>2. Shtesa p\u00ebr trajtimin minimal t\u00eb p\u00ebrmendur n\u00eb paragrafin e m\u00ebparsh\u00ebm \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi e vetme e institucionit kompetent t\u00eb shtetit kontraktues n\u00eb territorin e t\u00eb cilit banon p\u00ebrfituesi.<\/p>\n\n\n\n<p>Neni 17<\/p>\n\n\n\n<p><strong>Dispozita t\u00eb ve\u00e7anta<\/strong><\/p>\n\n\n\n<p>N\u00ebse legjislacioni i nj\u00ebrit prej shteteve kontraktuese ia n\u00ebnshtron dh\u00ebnien e p\u00ebrfitimeve kushtit q\u00eb<\/p>\n\n\n\n<p>punonj\u00ebsi t\u2019i n\u00ebnshtrohet k\u00ebtij legjislacioni n\u00eb momentin kur shfaqet rrisku ky kusht konsiderohet i&nbsp;plot\u00ebsuar n\u00ebse, me shfaqjen e rriskut, punonj\u00ebsi i n\u00ebnshtrohet legjislacionit t\u00eb nj\u00eb shteti tjet\u00ebr kontraktues ose mund ta k\u00ebrkoj\u00eb t\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitime n\u00eb k\u00ebt\u00eb t\u00eb fundit.<\/p>\n\n\n\n<p>KAPITULLI II&nbsp;<\/p>\n\n\n\n<p>PAPUN\u00cbSIA<\/p>\n\n\n\n<p>Neni 18<\/p>\n\n\n\n<p><strong>E drejta p\u00ebr p\u00ebrfitime<\/strong><\/p>\n\n\n\n<p>1. N\u00ebse nj\u00eb punonj\u00ebs nuk i plot\u00ebson kushtet e p\u00ebrcaktuara nga legjislacioni i nj\u00ebrit shtet kontraktues p\u00ebr t\u00eb drejt\u00ebn e p\u00ebrfitimit t\u00eb papun\u00ebsis\u00eb, duke u bazuar vet\u00ebm n\u00eb periudhat e pun\u00ebs q\u00eb u n\u00ebnshtrohen kontributeve t\u00eb plot\u00ebsuara sipas atij legjislacioni, institucioni kompetent i atij shteti do t\u00eb marr\u00eb parasysh, n\u00eb mas\u00ebn e nevojshme, periudhat p\u00ebrkat\u00ebse t\u00eb pun\u00ebs t\u00eb kryera sipas legjislacionit t\u00eb shtetit tjet\u00ebr kontraktues.<\/p>\n\n\n\n<p>2. Zbatimi i dispozitave q\u00eb p\u00ebrmban paragrafi i m\u00ebparsh\u00ebm varet nga kushti q\u00eb punonj\u00ebsi t\u2019i jet\u00eb n\u00ebnshtruar s\u00eb fundmi, p\u00ebr t\u00eb pakt\u00ebn gjasht\u00eb muaj, legjislacionit sipas t\u00eb cilit k\u00ebrkohen p\u00ebrfitimet.<\/p>\n\n\n\n<p>3. Nj\u00eb punonj\u00ebs q\u00eb plot\u00ebson kushtet e p\u00ebrcaktuara nga legjislacioni i nj\u00eb Shteti Kontraktues p\u00ebr t\u00eb drejt\u00ebn e p\u00ebrfitimit t\u00eb papun\u00ebsis\u00eb dhe shkon n\u00eb shtetin tjet\u00ebr kontraktues p\u00ebr t\u00eb k\u00ebrkuar pun\u00eb atje, e ruan t\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitime t\u00eb tilla sipas kushteve t\u00eb p\u00ebrcaktuara nga legjislacioni i shtetit n\u00eb t\u00eb cilin \u00ebsht\u00eb fituar e drejta, p\u00ebr nj\u00eb koh\u00ebzgjatje maksimale prej 3 muajsh, s\u00eb cil\u00ebs i zbritet periudha n\u00eb t\u00eb cil\u00ebn ai i ka g\u00ebzuar tashm\u00eb p\u00ebrfitimet n\u00eb at\u00eb shtet. Sh\u00ebrbimet do t\u00eb vazhdojn\u00eb t\u00eb ofrohen nga institucioni i shtetit kompetent n\u00eb m\u00ebnyr\u00ebn e p\u00ebrcaktuar n\u00eb Marr\u00ebveshjen administrative t\u00eb p\u00ebrmendur n\u00eb nenin 19.<\/p>\n\n\n\n<p>PJESA IV<\/p>\n\n\n\n<p><strong>Dispozita t\u00eb ndryshme<\/strong><\/p>\n\n\n\n<p>Neni 19<\/p>\n\n\n\n<p><strong>Marr\u00ebveshje administrative<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Autoritetet kompetente t\u00eb dy shteteve kontraktuese do t\u00eb bien dakord p\u00ebr legjislacionin zbatues t\u00eb k\u00ebsaj Marr\u00ebveshjeje me an\u00ebn e nj\u00eb marr\u00ebveshjeje administrative q\u00eb do t\u00eb b\u00ebhet e vlefshme n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb kur do t\u00eb hyj\u00eb n\u00eb fuqi kjo Marr\u00ebveshje.<\/p>\n\n\n\n<p>Neni 20<\/p>\n\n\n\n<p><strong>Shk\u00ebmbimi i informacioneve<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Autoritetet kompetente t\u00eb dy shteteve kontraktuese marrin p\u00ebrsip\u00ebr t\u00eb informojn\u00eb nj\u00ebri-tjetrin n\u00eb lidhje me:<\/p>\n\n\n\n<p>1. t\u00eb gjitha masat e marra p\u00ebr zbatimin e k\u00ebsaj Marr\u00ebveshjeje;<\/p>\n\n\n\n<p>2. t\u00eb gjitha v\u00ebshtir\u00ebsit\u00eb q\u00eb mund t\u00eb shfaqen n\u00eb nivel teknik p\u00ebr zbatimin e dispozitave t\u00eb Marr\u00ebveshjes;<\/p>\n\n\n\n<p>3. t\u00eb gjitha ndryshimet n\u00eb legjislacionet p\u00ebrkat\u00ebse q\u00eb ndikojn\u00eb n\u00eb zbatimin e k\u00ebsaj Marr\u00ebveshjeje.<\/p>\n\n\n\n<p>Neni 21<\/p>\n\n\n\n<p><strong>Bashk\u00ebpunimi administrativ<\/strong><strong><\/strong><\/p>\n\n\n\n<p>1. Autoritetet, institucionet kompetente dhe organet nd\u00ebrlidh\u00ebse t\u00eb dy shteteve kontraktuese marrin p\u00ebrsip\u00ebr t\u2019i ofrojn\u00eb nj\u00ebri-tjetrit ndihm\u00eb dhe bashk\u00ebpunim t\u00eb nd\u00ebrsjell\u00eb p\u00ebr zbatimin e k\u00ebsaj Marr\u00ebveshjeje. Ata mund t\u00eb p\u00ebrdorin, gjithashtu, kur \u00ebsht\u00eb e nevojshme, mjete hetimore n\u00eb shtetin tjet\u00ebr kontraktues, n\u00ebp\u00ebrmjet autoriteteve diplomatike dhe konsullore t\u00eb atij shteti.<\/p>\n\n\n\n<p>2. Autoritetet, institucionet kompetente dhe zyrat nd\u00ebrlidh\u00ebse italiane, q\u00eb bashk\u00ebpunojn\u00eb p\u00ebr zbatimin e k\u00ebsaj marr\u00ebveshjeje, e b\u00ebjn\u00eb k\u00ebt\u00eb n\u00eb kuad\u00ebr t\u00eb veprimtaris\u00eb s\u00eb vet institucionale, pa kosto t\u00eb reja apo t\u00eb shtuara p\u00ebr buxhetin publik, edhe duke iu referuar n\u00eb m\u00ebnyr\u00eb specifike detyrimeve t\u00eb parashikuara n\u00eb k\u00ebt\u00eb titull.<\/p>\n\n\n\n<p>3. Nj\u00eb pal\u00eb kontraktuese v\u00eb n\u00eb dispozicion t\u00eb pal\u00ebs tjet\u00ebr kontraktuese falas dokumentacionin n\u00eb lidhje me verifikimet dhe kontrollet mjek\u00ebsore t\u00eb kryera m\u00eb par\u00eb q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me personat q\u00eb banojn\u00eb ose q\u00ebndrojn\u00eb n\u00eb territorin e shtetit tjet\u00ebr kontraktues, p\u00ebr q\u00ebllime t\u00eb k\u00ebsaj Marr\u00ebveshjeje. Verifikimet dhe kontrollet mjek\u00ebsore q\u00eb kryhen p\u00ebr zbatimin e legjislacionit t\u00eb nj\u00ebrit shtet kontraktues dhe q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me personat q\u00eb banojn\u00eb ose q\u00ebndrojn\u00eb n\u00eb territorin e shtetit tjet\u00ebr kontraktues, duhet t\u00eb urdh\u00ebrohen nga institucioni i vendq\u00ebndrimit ose i vendq\u00ebndrimit, me k\u00ebrkes\u00eb t\u00eb institucioneve kompetente dhe me shpenzimet e tij. N\u00eb Marr\u00ebveshjen administrative, t\u00eb p\u00ebrcaktuar n\u00eb nenin 19, do t\u00eb p\u00ebrcaktohen dispozitat p\u00ebr rimbursimin e shpenzimeve. Shpenzimet p\u00ebr kontrollet sh\u00ebndet\u00ebsore dhe verifikimet e kryera n\u00eb interes t\u00eb institucioneve t\u00eb t\u00eb dyja shteteve nuk japin t\u00eb drejt\u00ebn p\u00ebr rimbursim.<\/p>\n\n\n\n<p>Neni 22<\/p>\n\n\n\n<p><strong>Ndihma diplomatike&nbsp;dhe konsullore<\/strong><\/p>\n\n\n\n<p>Autoritetet diplomatike dhe konsullore t\u00eb secilit shtet kontraktues mund t\u2019u drejtohen drejtp\u00ebrdrejt autoriteteve, institucioneve kompetente dhe organeve nd\u00ebrlidh\u00ebse t\u00eb shtetit tjet\u00ebr kontraktues p\u00ebr t\u00eb marr\u00eb informacione t\u00eb dobishme p\u00ebr mbrojtjen e qytetar\u00ebve t\u00eb shtetit t\u00eb tyre, t\u00eb cil\u00ebt ata i konsiderojn\u00eb si mbajt\u00ebs t\u00eb t\u00eb drejtave mbi baz\u00ebn e pranimit t\u00eb Marr\u00ebveshjes n\u00eb fjal\u00eb dhe mund t\u2019i p\u00ebrfaq\u00ebsojn\u00eb ata pa pasur nj\u00eb mandat t\u00eb posa\u00e7\u00ebm.<\/p>\n\n\n\n<p>Neni 23<\/p>\n\n\n\n<p><strong>P\u00ebrjashtimet&nbsp;dhe njohja e v\u00ebrtetimeve<\/strong><\/p>\n\n\n\n<p>1. N\u00ebse legjislacioni i nj\u00eb shteti kontraktues, parashikon p\u00ebrjashtimin nga taksat, vulat apostile apo tarifat p\u00ebr k\u00ebrkesa apo dokumente t\u00eb cilat duhen paraqitur sipas k\u00ebtij legjislacioni, at\u00ebher\u00eb ky p\u00ebrjashtim vlen edhe p\u00ebr k\u00ebrkesa dhe dokumente t\u00eb cilat paraqiten apo l\u00ebshohen nga institucionet dhe autoritetet kompetente t\u00eb shtetit tjet\u00ebr kontraktues p\u00ebr zbatimin e k\u00ebsaj Marr\u00ebveshjeje.<\/p>\n\n\n\n<p>2. T\u00eb gjitha aktet, dokumentet dhe gjith\u00e7ka tjet\u00ebr e shkruar, t\u00eb cilat duhet t\u00eb paraqiten p\u00ebr zbatimin e k\u00ebsaj Marr\u00ebveshjeje, jan\u00eb t\u00eb p\u00ebrjashtuara nga viza e legalizimit nga autoritetet diplomatike dhe konsullore.<\/p>\n\n\n\n<p>3. V\u00ebrtetimi, i l\u00ebshuar nga autoritetet, institucionet kompetente dhe organet nd\u00ebrlidh\u00ebse t\u00eb nj\u00ebrit shtet kontraktues, n\u00eb lidhje me v\u00ebrtet\u00ebsin\u00eb e nj\u00eb certifikate ose dokumenti, konsiderohet e vlefshme nga autoritetet p\u00ebrkat\u00ebse, institucionet dhe organet nd\u00ebrlidh\u00ebse t\u00eb shtetit tjet\u00ebr kontraktues.<\/p>\n\n\n\n<p>Neni 24<\/p>\n\n\n\n<p><strong>Organet e nd\u00ebrlidhjes<\/strong><\/p>\n\n\n\n<p>P\u00ebr t\u00eb leht\u00ebsuar zbatimin e k\u00ebsaj Marr\u00ebveshjeje dhe p\u00ebr t\u00eb lejuar nj\u00eb lidhje m\u00eb t\u00eb shpejt\u00eb nd\u00ebrmjet institucioneve t\u00eb t\u00eb dyja shteteve kontraktuese, autoritetet kompetente do t\u00eb caktojn\u00eb organet nd\u00ebrlidh\u00ebse.<\/p>\n\n\n\n<p>Neni 25<\/p>\n\n\n\n<p><strong>K\u00ebrkesat, deklaratat dhe ankesat<\/strong><\/p>\n\n\n\n<p>1. K\u00ebrkesat, deklaratat dhe ankesat q\u00eb i paraqiten n\u00eb kuadrin e zbatimit t\u00eb k\u00ebsaj Marr\u00ebveshjeje, nj\u00eb autoriteti, institucioni ose nj\u00eb organi nd\u00ebrlidh\u00ebs t\u00eb nj\u00ebrit shtet kontraktues, konsiderohen, si: k\u00ebrkesa, deklarata ose ankesa q\u00eb i paraqiten autoritetit, institucionit p\u00ebrkat\u00ebs ose organi nd\u00ebrlidh\u00ebs t\u00eb shtetit tjet\u00ebr kontraktues.<\/p>\n\n\n\n<p>2. Ankesat q\u00eb duhet t\u00eb depozitohen brenda nj\u00eb periudhe t\u00eb caktuar pran\u00eb nj\u00eb autoriteti ose institucioni kompetent t\u00eb nj\u00ebrit shtet kontraktues, konsiderohen t\u00eb paraqitura brenda afatit n\u00ebse ato i jan\u00eb paraqitur brenda s\u00eb nj\u00ebjt\u00ebs periudh\u00eb nj\u00eb autoriteti ose institucioni p\u00ebrkat\u00ebs t\u00eb shtetit tjet\u00ebr kontraktues. N\u00eb k\u00ebt\u00eb rast, autoriteti ose institucioni t\u00eb cilit i jan\u00eb paraqitur ankesat, do t\u2019ia p\u00ebrcjell\u00eb ato pa vones\u00eb autoritetit apo institucionit kompetent t\u00eb shtetit tjet\u00ebr kontraktues.<\/p>\n\n\n\n<p>Neni 26<\/p>\n\n\n\n<p><strong>Let\u00ebrk\u00ebmbimi nd\u00ebrmjet&nbsp;<\/strong><strong>autoriteteve,&nbsp;institucioneve dhe organeve nd\u00ebrlidh\u00ebse<\/strong><\/p>\n\n\n\n<p>Autoritetet, institucionet kompetente dhe organet nd\u00ebrlidh\u00ebse t\u00eb dy shteteve kontraktuese, p\u00ebr zbatimin e k\u00ebsaj Marr\u00ebveshjeje, mbajn\u00eb let\u00ebrk\u00ebmbim t\u00eb drejtp\u00ebrdrejt\u00eb me nj\u00ebra-tjetr\u00ebn, me punonj\u00ebsit dhe p\u00ebrfaq\u00ebsuesit e tyre, duke e hartuar let\u00ebrk\u00ebmbimin n\u00eb gjuh\u00ebt e tyre komb\u00ebtare&nbsp;p\u00ebrkat\u00ebse.<\/p>\n\n\n\n<p>Neni 27<\/p>\n\n\n\n<p><strong>Pagesa e&nbsp;p\u00ebrfitimeve<\/strong><\/p>\n\n\n\n<p>1. Pagesa e p\u00ebrfitimeve p\u00ebr p\u00ebrfituesit q\u00eb banojn\u00eb n\u00eb shtetin e Pal\u00ebs tjet\u00ebr Kontraktuese duhet t\u00eb kryhet n\u00eb monedh\u00ebn e Pal\u00ebs Kontraktuese q\u00eb kryen pages\u00ebn dhe n\u00eb p\u00ebrputhje me legjislacionin q\u00eb ajo zbaton.<\/p>\n\n\n\n<p>2. P\u00ebr q\u00ebllimet e zbatimit t\u00eb paragrafit 1, kurset e referimit t\u00eb k\u00ebmbimit jan\u00eb si m\u00eb posht\u00eb:<\/p>\n\n\n\n<p>&#8211; p\u00ebr Shqip\u00ebrin\u00eb, kursi ditor i k\u00ebmbimit t\u00eb bank\u00ebs q\u00eb kryen pages\u00ebn;<\/p>\n\n\n\n<p>&#8211; p\u00ebr Italin\u00eb, ato t\u00eb publikuara nga Banka e Italis\u00eb.<\/p>\n\n\n\n<p>Neni 28<\/p>\n\n\n\n<p><strong>Rikuperimet<\/strong><\/p>\n\n\n\n<p>Institucioni i nj\u00ebrit shtet kontraktues i cili ka paguar nj\u00eb p\u00ebrfitim t\u00eb paligjsh\u00ebm ose nj\u00eb shum\u00eb q\u00eb e tejkalon at\u00eb p\u00ebr t\u00eb cil\u00ebn p\u00ebrfituesi do t\u00eb kishte t\u00eb drejt\u00eb, mund t\u2019i k\u00ebrkoj\u00eb institucionit kompetent t\u00eb shtetit tjet\u00ebr kontraktues t\u00eb rikuperoj\u00eb shumat e paguar n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme p\u00ebr pagesat e prapambetura t\u00eb pensioneve ose p\u00ebr ndonj\u00eb p\u00ebrfitim tjet\u00ebr q\u00eb i detyrohen p\u00ebrfituesit. Institucioni i shtetit kontraktues i ngarkuar p\u00ebr rikuperimin e kryen mbajtjen n\u00eb burim sipas kushteve dhe brenda kufijve t\u00eb parashikuara p\u00ebr k\u00ebt\u00eb kompensim n\u00eb p\u00ebrputhje me legjislacionin e zbatuar nga vet\u00eb ai. Shumat e mbajtura n\u00eb burim i transferohen institucionit kreditor.<\/p>\n\n\n\n<p>Neni 29<\/p>\n\n\n\n<p><strong>Mbrojtja e t\u00eb dh\u00ebnave personale<\/strong><\/p>\n\n\n\n<p>\u00c7do e&nbsp;dh\u00ebn\u00eb q\u00eb lidhet me individ\u00ebt q\u00eb, p\u00ebr zbatimin&nbsp;e&nbsp;k\u00ebsaj Marr\u00ebveshjeje, p\u00ebrcillet nga nj\u00ebri shtet<strong>&nbsp;<\/strong>kontraktues n\u00eb tjetrin, duhet t\u00eb mbahet konfidenciale dhe t\u00eb p\u00ebrdoret ekskluzivisht p\u00ebr t\u00eb p\u00ebrcaktuar t\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitime n\u00eb baz\u00eb t\u00eb k\u00ebsaj Marr\u00ebveshjeje.<\/p>\n\n\n\n<p>T\u00eb gjitha shk\u00ebmbimet e t\u00eb dh\u00ebnave nd\u00ebrmjet Shteteve kontraktuese do t\u00eb rregullohen nga dispozitat e p\u00ebrcaktuara n\u00eb aneksin 1 t\u00eb k\u00ebsaj Marr\u00ebveshjeje.<\/p>\n\n\n\n<p>PJESA V<\/p>\n\n\n\n<p><strong>Dispozita kalimtare dhe p\u00ebrfundimtare<\/strong><\/p>\n\n\n\n<p>Neni 30<\/p>\n\n\n\n<p><strong>Data e hyrjes n\u00eb fuqi<\/strong><\/p>\n\n\n\n<p>1. Dispozitat e k\u00ebsaj Marr\u00ebveshjeje zbatohen p\u00ebr k\u00ebrkesat p\u00ebr p\u00ebrfitime t\u00eb paraqitura nga data e hyrjes s\u00eb saj n\u00eb fuqi.<\/p>\n\n\n\n<p>2. P\u00ebr q\u00ebllimet e k\u00ebsaj Marr\u00ebveshjeje, do t\u00eb merren parasysh edhe periudhat e sigurimit q\u00eb jan\u00eb plot\u00ebsuar p\u00ebrpara hyrjes s\u00eb saj n\u00eb fuqi.<\/p>\n\n\n\n<p>3. Kjo Marr\u00ebveshje nuk jep t\u00eb drejt\u00ebn p\u00ebr p\u00ebrfitime p\u00ebr periudha p\u00ebrpara hyrjes s\u00eb saj n\u00eb fuqi.<\/p>\n\n\n\n<p>4. Nj\u00eb e drejt\u00eb p\u00ebr p\u00ebrfitime fitohet sipas k\u00ebsaj Marr\u00ebveshjeje, edhe n\u00ebse ajo ka t\u00eb b\u00ebj\u00eb me nj\u00eb ngjarje t\u00eb mbuluar me sigurim, e cila ka ndodhur p\u00ebrpara dat\u00ebs s\u00eb hyrjes s\u00eb saj n\u00eb fuqi.<\/p>\n\n\n\n<p>Neni 31<\/p>\n\n\n\n<p><strong>Hyrja n\u00eb fuqi<\/strong><\/p>\n\n\n\n<p>1. Kjo Marr\u00ebveshje do t\u00eb ratifikohet nga t\u00eb dyja shtetet kontraktuese, n\u00eb p\u00ebrputhje me procedurat e tyre p\u00ebrkat\u00ebse dhe instrumentet e ratifikimit do t\u00eb shk\u00ebmbehen sa m\u00eb shpejt q\u00eb t\u00eb jet\u00eb e mundur.<\/p>\n\n\n\n<p>2. Kjo Marr\u00ebveshje do t\u00eb hyj\u00eb n\u00eb fuqi nj\u00ebkoh\u00ebsisht me Marr\u00ebveshjen Administrative t\u00eb p\u00ebrmendur n\u00eb nenin 19, n\u00eb dit\u00ebn e par\u00eb t\u00eb muajit t\u00eb dyt\u00eb pas shk\u00ebmbimit t\u00eb dokumenteve t\u00eb ratifikimit.<\/p>\n\n\n\n<p>3. Kjo Marr\u00ebveshje mund t\u00eb denoncohet nga nj\u00ebri shtet kontraktues dhe do t\u00eb pushoj\u00eb s\u00eb qeni n\u00eb fuqi gjasht\u00eb muaj pas njoftimit p\u00ebrkat\u00ebs t\u00eb saj n\u00ebp\u00ebrmjet kanaleve diplomatike.<\/p>\n\n\n\n<p>4. N\u00eb rast denoncimi t\u00eb k\u00ebsaj Marr\u00ebveshjeje:<\/p>\n\n\n\n<p>a) t\u00eb drejtat e fituara do t\u00eb ruhen n\u00eb p\u00ebrputhje me dispozitat e k\u00ebsaj Marr\u00ebveshjeje;<\/p>\n\n\n\n<p>b) t\u00eb gjitha procedurat n\u00eb vazhdim p\u00ebr njohjen e t\u00eb drejtave do t\u00eb p\u00ebrfundojn\u00eb n\u00eb p\u00ebrputhje me dispozitat e k\u00ebsaj Marr\u00ebveshjeje;<\/p>\n\n\n\n<p>c) t\u00eb drejtat q\u00eb ndodhen n\u00eb proces fitimi do t\u00eb njihen sipas marr\u00ebveshjeve q\u00eb do t\u00eb lidhen nd\u00ebrmjet dy shteteve kontraktuese.<\/p>\n\n\n\n<p>N\u00ebnshkruar m\u00eb 6.2.2024,&nbsp;n\u00eb&nbsp;Rom\u00eb,&nbsp;n\u00eb dy kopje origjinale, secila n\u00eb gjuh\u00ebn shqipe dhe n\u00eb gjuh\u00ebn italiane, t\u00eb cilat jan\u00eb t\u00eb gjitha t\u00eb barasvlefshme.<\/p>\n\n\n\n<p>P\u00ebr K\u00ebshillin e Ministrave t\u00eb&nbsp;Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb<\/p>\n\n\n\n<p>P\u00ebr Qeverin\u00eb e Republik\u00ebs s\u00eb Italis\u00eb<\/p>\n\n\n\n<p>ANEKSI 1<\/p>\n\n\n\n<p>KLAUZOLA P\u00cbR TRANSFERIMIN E T\u00cb DH\u00cbNAVE PERSONALE ND\u00cbRMJET AUTORITETEVE KOMPETENTE T\u00cb P\u00cbRCAKTUARA N\u00cb NENIN 29 T\u00cb MARR\u00cbVESHJES ND\u00cbRMJET REPUBLIK\u00cbS S\u00cb SHQIP\u00cbRIS\u00cb DHE REPUBLIK\u00cbS ITALIANE N\u00cb FUSH\u00cbN E SIGURIMEVE SHOQ\u00cbRORE<\/p>\n\n\n\n<p>Duke marr\u00eb parasysh nenin 46(2) (a) t\u00eb rregullores (BE) 2016\/679 t\u00eb Parlamentit Evropian dhe t\u00eb K\u00ebshillit t\u00eb 27 prillit 2016, q\u00eb ka t\u00eb b\u00ebj\u00eb me mbrojtjen e personave fizik\u00eb n\u00eb lidhje me p\u00ebrpunimin e t\u00eb dh\u00ebnave personale, si edhe me qarkullimin e lir\u00eb t\u00eb k\u00ebtyre t\u00eb dh\u00ebnave dhe q\u00eb shfuqizon Direktiv\u00ebn 95\/46\/CE (Rregullorja e P\u00ebrgjithshme p\u00ebr Mbrojtjen e t\u00eb Dh\u00ebnave\/RGPD) dhe ligjit shqiptar nr. 9887, dat\u00eb 10.3.2008 \u201cP\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale\u201d.<\/p>\n\n\n\n<p>Secili \u201cAutoritet Kompetent\u201d i nj\u00ebr\u00ebs Pal\u00eb (q\u00eb n\u00eb vijim do t\u00eb quhet \u201cAutoriteti\u201d), n\u00eb zbatim t\u00eb nenit 1, germa \u201cc\u201d, t\u00eb marr\u00ebveshjes nd\u00ebrmjet Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe Republik\u00ebs s\u00eb Italis\u00eb p\u00ebr sigurimet shoq\u00ebrore (q\u00eb n\u00eb vijim do t\u00eb quhet Marr\u00ebveshja) do t\u00eb zbatoj\u00eb garancit\u00eb e p\u00ebrcaktuara n\u00eb pikat e k\u00ebtij aneksi p\u00ebr transferimin e t\u00eb dh\u00ebnave personale te nj\u00eb Autoritet i Pal\u00ebs tjet\u00ebr. K\u00ebto garanci jan\u00eb t\u00eb detyrueshme p\u00ebr Pal\u00ebt dhe mbizot\u00ebrojn\u00eb mbi \u00e7do detyrim konfliktual q\u00eb ekziston n\u00eb sistemet e tyre ligjore p\u00ebrkat\u00ebse.<\/p>\n\n\n\n<p><strong>I. P\u00ebrkufizime<\/strong><\/p>\n\n\n\n<p>P\u00ebr q\u00ebllimet e k\u00ebtyre klauzolave, n\u00ebnkuptohet me:<\/p>\n\n\n\n<p>a) \u201ct\u00eb dh\u00ebnat personale\u201d \u00e7far\u00ebdolloj informacioni n\u00eb lidhje me nj\u00eb person fizik t\u00eb identifikuar ose t\u00eb identifikuesh\u00ebm (\u201ci interesuari\u201d) n\u00eb p\u00ebrputhje me marr\u00ebveshjen. Konsiderohet i identifikuesh\u00ebm personi fizik, i cili mund t\u00eb identifikohet, drejtp\u00ebrdrejt ose t\u00ebrthorazi, duke iu referuar n\u00eb ve\u00e7anti nj\u00eb t\u00eb dh\u00ebne identifikuese, si emri, nj\u00eb num\u00ebr identifikimi, t\u00eb dh\u00ebnave p\u00ebrkat\u00ebse t\u00eb vendndodhjes, nj\u00eb emri identifikues n\u00eb rrjet ose nj\u00ebrit apo m\u00eb shum\u00eb elementeve karakteristike t\u00eb identitetit t\u00eb tij fizik, fiziologjik, gjenetik, psikik, ekonomik, kulturor apo shoq\u00ebror;<\/p>\n\n\n\n<p>b) \u201ct\u00eb dh\u00ebna t\u00eb ve\u00e7anta\u201d: t\u00eb dh\u00ebna personale q\u00eb zbulojn\u00eb prejardhjen racore ose etnike, opinionet politike, besimet fetare ose filozofike, an\u00ebtar\u00ebsimin n\u00eb sindikata, penale ose masat e lidhura me sigurin\u00eb;<\/p>\n\n\n\n<p>d) \u201ct\u00eb dh\u00ebna t\u00eb p\u00ebrbashk\u00ebta\u201d t\u00eb dh\u00ebna personale q\u00eb nuk jan\u00eb t\u00eb ve\u00e7anta ose proceseve t\u00eb automatizuara, si p\u00ebr shembull.: mbledhja, regjistrimi, organizimi, strukturimi, ruajtja, p\u00ebrshtatja ose ndryshimi, nxjerrja, konsultimi, p\u00ebrdorimi, komunikimi n\u00ebp\u00ebrmjet transmetimit, shp\u00ebrndarjes ose \u00e7far\u00ebdo lloj forme tjet\u00ebr t\u00eb v\u00ebnies t\u00eb tyre n\u00eb dispozicion, krahasimit ose nd\u00ebrlidhjes, kufizimi, anulimit ose asgj\u00ebsimit;<\/p>\n\n\n\n<p>f) \u201ctransferim\u201d d\u00ebrgimi i t\u00eb dh\u00ebnave personale nga nj\u00eb Autoritet i nj\u00ebr\u00ebs Pal\u00eb te nj\u00eb Autoritet i Pal\u00ebs tjet\u00ebr;<\/p>\n\n\n\n<p>g) \u201ckomunikim i m\u00ebtejsh\u00ebm\u201d d\u00ebrgimi i t\u00eb dh\u00ebnave personale nga nj\u00eb Autoritet marr\u00ebs tek nj\u00eb Autoritet tjet\u00ebr i t\u00eb nj\u00ebjtin vend;<\/p>\n\n\n\n<p>h) \u201ctransferim i m\u00ebtejsh\u00ebm\u201d: d\u00ebrgimi i t\u00eb dh\u00ebnave personale nga nj\u00eb Autoritet marr\u00ebs tek nj\u00eb Fusha e zbatimit<\/strong><\/p>\n\n\n\n<p>K\u00ebto klauzola zbatohen ekskluzivisht p\u00ebr q\u00ebllimet e ndjekura nga Qeveria e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe nga Qeveria e Republik\u00ebs Italiane me Marr\u00ebveshjen n\u00eb fush\u00ebn e sigurimeve shoq\u00ebrore, fusha e zbatimit t\u00eb s\u00eb cil\u00ebs, material dhe personal, p\u00ebrcaktohet n\u00eb m\u00ebnyr\u00eb specifike nga nenet 2 dhe 3 t\u00eb saj.<\/p>\n\n\n\n<p>P\u00ebr realizimin e q\u00ebllimeve t\u00eb sip\u00ebrp\u00ebrmendura, autoritetet mund t\u00eb shk\u00ebmbejn\u00eb t\u00eb dh\u00ebnat personale t\u00eb t\u00eb interesuarve:<\/p>\n\n\n\n<p>1.&nbsp;<em>t\u00eb dh\u00ebna t\u00eb p\u00ebrbashk\u00ebta<\/em>: t\u00eb dh\u00ebna personale, t\u00eb sigurimeve shoq\u00ebrore, bankare, tatimore, t\u00eb t\u00eb ardhurave, t\u00eb kontributeve, t\u00eb pagave;<\/p>\n\n\n\n<p>2.&nbsp;<em>kategori t\u00eb ve\u00e7anta t\u00eb t\u00eb dh\u00ebnave:<\/em>&nbsp;t\u00eb dh\u00ebna sh\u00ebndet\u00ebsore;<\/p>\n\n\n\n<p>3.&nbsp;<em>t\u00eb dh\u00ebna penale<\/em>: d\u00ebnimet penale, veprat penale dhe masat e siguris\u00eb q\u00eb lidhen me to.<\/p>\n\n\n\n<p><strong>III. Garancit\u00eb p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale<\/strong><\/p>\n\n\n\n<p>P\u00ebr p\u00ebrpunimet e t\u00eb dh\u00ebnave q\u00eb kryhen n\u00eb p\u00ebrputhje me k\u00ebt\u00eb Marr\u00ebveshje, autoritetet sigurojn\u00eb dhe jan\u00eb n\u00eb gjendje t\u00eb provojn\u00eb respektimin e parimeve t\u00eb m\u00ebposhtme:<\/p>\n\n\n\n<p><strong>1. Kufizimi i q\u00ebllimeve<\/strong><\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat personale do t\u00eb transferohen nd\u00ebrmjet Autoriteteve me q\u00ebllimin e vet\u00ebm p\u00ebr t\u00eb p\u00ebrmbushur q\u00ebllimet e treguara n\u00eb paragrafin II. Autoritetet nuk do t\u00eb kryejn\u00eb komunikime ose transferime t\u00eb m\u00ebtejshme t\u00eb t\u00eb dh\u00ebnave personale p\u00ebr q\u00ebllime t\u00eb ndryshme nga ato t\u00eb treguara m\u00eb sip\u00ebr, duke u kujdesur q\u00eb t\u00eb marrin garancit\u00eb e duhura n\u00eb m\u00ebnyr\u00eb q\u00eb p\u00ebrpunimet e m\u00ebvonshme t\u00eb kufizohen n\u00eb k\u00ebto q\u00ebllime, duke marr\u00eb parasysh at\u00eb q\u00eb tregohet n\u00eb pik\u00ebn III.6.<\/p>\n\n\n\n<p><strong>2. Proporcionaliteti dhe cil\u00ebsia e t\u00eb dh\u00ebnave<\/strong><\/p>\n\n\n\n<p>Autoriteti transferues do t\u00eb d\u00ebrgoj\u00eb vet\u00ebm t\u00eb dh\u00ebna personale q\u00eb jan\u00eb t\u00eb p\u00ebrshtatshme, t\u00eb r\u00ebnd\u00ebsishme dhe t\u00eb kufizuara p\u00ebr q\u00ebllimet p\u00ebr t\u00eb cilat atoo transferohen dhe p\u00ebrpunohen m\u00eb pas, n\u00eb zbatim t\u00eb parimit t\u00eb minimizimit t\u00eb t\u00eb dh\u00ebnave dhe, rrjedhimisht, t\u00eb mostepric\u00ebs dhe p\u00ebrkat\u00ebsis\u00eb s\u00eb t\u00eb dh\u00ebnave kundrejt q\u00ebllimeve t\u00eb ndjekura. Transferimi i t\u00eb dh\u00ebnave t\u00eb ve\u00e7anta ose penale lejohet vet\u00ebm n\u00ebse \u00ebsht\u00eb ngusht\u00ebsisht e domosdoshme p\u00ebr p\u00ebrmbushjen e q\u00ebllimeve t\u00eb marr\u00ebveshjes.<\/p>\n\n\n\n<p>Autoriteti transferues do t\u00eb siguroj\u00eb q\u00eb, nga sa ka vet\u00eb dijeni, t\u00eb dh\u00ebnat personale q\u00eb ai transferon, jan\u00eb t\u00eb sakta dhe, n\u00ebse \u00ebsht\u00eb e nevojshme, t\u00eb p\u00ebrdit\u00ebsuara. N\u00ebse nj\u00eb Autoritet merr dijeni p\u00ebr faktin se t\u00eb dh\u00ebnat personale q\u00eb ka transferuar jan\u00eb t\u00eb pasakta, ai do t\u00eb informoj\u00eb Autoritetin marr\u00ebs, i cili do t\u00eb kryej\u00eb korrigjimet e rastit.<\/p>\n\n\n\n<p><strong>3. Transparenca<\/strong><\/p>\n\n\n\n<p>Secili Autoritet do t\u2019u jap\u00eb informacion t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb interesuarve n\u00eb lidhje me:<\/p>\n\n\n\n<p>a) identitetin dhe t\u00eb dh\u00ebnat e kontaktit t\u00eb p\u00ebrgjegj\u00ebsit p\u00ebr p\u00ebrpunimin e t\u00eb dh\u00ebnave dhe, kur \u00ebsht\u00eb i pranish\u00ebm, t\u00eb p\u00ebrgjegj\u00ebsit p\u00ebr mbrojtjen e t\u00eb dh\u00ebnave;<\/p>\n\n\n\n<p>b) q\u00ebllimin, baz\u00ebn ligjore dhe metodat e p\u00ebrpunimit t\u00eb t\u00eb dh\u00ebnave personale, duke p\u00ebrfshir\u00eb periudh\u00ebn e ruajtjes s\u00eb tyre;<\/p>\n\n\n\n<p>c) marr\u00ebsit, t\u00eb cil\u00ebve t\u00eb dh\u00ebna e sip\u00ebrp\u00ebrmendura mund t\u2019u transferohen ose d\u00ebrgohen si komunikim ose transferim t\u00eb m\u00ebtejsh\u00ebm, duke u kujdesur t\u00eb specifikojn\u00eb garancit\u00eb e parashikuara dhe arsyet e d\u00ebrgimit;<\/p>\n\n\n\n<p>d) t\u00eb drejtat e t\u00eb interesuarve, n\u00eb p\u00ebrputhje me k\u00ebto klauzola dhe me k\u00ebrkesat ligjore t\u00eb zbatueshme, duke p\u00ebrfshir\u00eb metodat e ushtrimit t\u00eb k\u00ebtyre t\u00eb drejtave;<\/p>\n\n\n\n<p>e) informacionet mbi vonesa apo kufizime t\u00eb mundshme, t\u00eb zbatueshme n\u00eb lidhje me ushtrimin e k\u00ebtyre t\u00eb drejtave;<\/p>\n\n\n\n<p>f) t\u00eb drejt\u00ebn p\u00ebr t\u00eb paraqitur nj\u00eb ankes\u00eb pran\u00eb nj\u00eb autoriteti mbik\u00ebqyr\u00ebs, duke specifikuar t\u00eb dh\u00ebnat p\u00ebrkat\u00ebse t\u00eb kontaktit, si edhe p\u00ebr t\u2019u ankuar pran\u00eb nj\u00eb autoriteti gjyq\u00ebsor;<a href=\"applewebdata:\/\/43B900F6-6539-4D57-86AD-8486D2E7C1AC#_ftn2\"><sup>[2]<\/sup><\/a><\/p>\n\n\n\n<p>T\u00eb drejtat e t\u00eb interesuarve mund t\u00eb kufizohen, n\u00eb nj\u00eb mas\u00eb t\u00eb nevojshme dhe proporcionale n\u00eb nj\u00eb shoq\u00ebri demokratike, p\u00ebr t\u00eb mbrojtur objektiva t\u00eb r\u00ebnd\u00ebsish\u00ebm me interes publik t\u00eb njohura nga Pal\u00ebt, n\u00eb frym\u00ebn e reciprocitetit t\u00eb duhur p\u00ebr bashk\u00ebpunim nd\u00ebrkomb\u00ebtar. P\u00ebrfshihen n\u00eb k\u00ebt\u00eb kuad\u00ebr mbrojtja e t\u00eb drejtave dhe lirive t\u00eb t\u00eb tjer\u00ebve, siguria komb\u00ebtare, mbrojtja, parandalimi, hetimi, zbulimi dhe ndjekja penale e krimeve, si dhe kryerja e nj\u00eb funksioni kontrolli, inspektimi ose rregullimi, t\u00eb cil\u00ebt jan\u00eb t\u00eb lidhur, qoft\u00eb edhe rast\u00ebsisht, me veprimtarit\u00eb e ekzekutimit dhe t\u00eb mbik\u00ebqyrjes s\u00eb autoriteteve, q\u00eb veprojn\u00eb n\u00eb ushtrimin e kompetencave publike, t\u00eb cilat u jan\u00eb ngarkuar atyre. Kufizimet e sip\u00ebrp\u00ebrmendura, t\u00eb rregulluara me ligj, mund t\u00eb vazhdojn\u00eb t\u00eb ekzistojn\u00eb vet\u00ebm p\u00ebr aq koh\u00eb sa ekziston arsyeja q\u00eb i ka lindur ato.<\/p>\n\n\n\n<p><strong>6. Komunikimi dhe transferimi i m\u00ebtejsh\u00ebm i t\u00eb dh\u00ebnave personale<\/strong><\/p>\n\n\n\n<p><em>6.1 Komunikimi i m\u00ebtejsh\u00ebm i t\u00eb dh\u00ebnave personale<\/em><\/p>\n\n\n\n<p>Nj\u00eb Autoritet marr\u00ebs mund t\u00eb vazhdoj\u00eb me komunikimin e m\u00ebtejsh\u00ebm t\u00eb t\u00eb dh\u00ebnave personale drejtuar nj\u00eb Autoriteti tjet\u00ebr t\u00eb t\u00eb nj\u00ebjtin vend vet\u00ebm me autorizimin paraprak me shkrim t\u00eb Autoritetit transferues dhe me kusht q\u00eb Autoriteti tjet\u00ebr i sip\u00ebrp\u00ebrmendur t\u00eb jap\u00eb t\u00eb nj\u00ebjtat garanci t\u00eb parashikuara nga k\u00ebto klauzola. N\u00eb k\u00ebrkes\u00ebn p\u00ebr autorizim me shkrim, Autoriteti marr\u00ebs duhet t\u00eb jap\u00eb informacione t\u00eb mjaftueshme p\u00ebr llojin e t\u00eb dh\u00ebnave q\u00eb synon t\u00eb komunikoj\u00eb, p\u00ebr Autoritetin tjet\u00ebr marr\u00ebs t\u00eb sip\u00ebrp\u00ebrmendur, si edhe p\u00ebr baz\u00ebn ligjore, arsyet dhe q\u00ebllimet e komunikimit.<\/p>\n\n\n\n<p>Autoriteti marr\u00ebs do t\u00eb mundet t\u00eb vazhdoj\u00eb, n\u00eb m\u00ebnyr\u00eb t\u00eb jasht\u00ebzakonshme, me komunikimin e m\u00ebtejsh\u00ebm t\u00eb t\u00eb dh\u00ebnave personale nj\u00eb Autoritet tjet\u00ebr t\u00eb t\u00eb nj\u00ebjtin vend, pa autorizimin paraprak t\u00eb Autoritetit transferues, vet\u00ebm n\u00ebse \u00ebsht\u00eb e nevojshme p\u00ebr t\u00eb pakt\u00ebn nj\u00eb nga arsyet e m\u00ebposhtme:<\/p>\n\n\n\n<p>&#8211; mbrojtjen e interesave jetike t\u00eb nj\u00eb pale t\u00eb interesuar ose t\u00eb nj\u00eb personi tjet\u00ebr fizik:<\/p>\n\n\n\n<p>&#8211; verifikimin, ushtrimin ose mbrojtjen e nj\u00eb t\u00eb drejt\u00eb n\u00eb nj\u00eb kontekst administrativ ose gjyq\u00ebsor;<\/p>\n\n\n\n<p>&#8211; kryerjen e nj\u00eb hetimi ose nj\u00eb procedimi penal t\u00eb lidhur ngusht\u00eb me veprimtarit\u00eb p\u00ebr t\u00eb cilat jan\u00eb transferuar t\u00eb dh\u00ebnat personale.<\/p>\n\n\n\n<p>N\u00eb rastet e sip\u00ebrp\u00ebrmendura, Autoriteti marr\u00ebs do t\u00eb informoj\u00eb paraprakisht Autoritetin transferues p\u00ebr komunikimin e m\u00ebtejsh\u00ebm, duke dh\u00ebn\u00eb elemente mbi t\u00eb dh\u00ebnat e k\u00ebrkuara, Autoritetin tjet\u00ebr k\u00ebrkues dhe baz\u00ebn ligjore p\u00ebrkat\u00ebse. N\u00ebse informacioni paraprak bie ndesh me detyrimin e konfidencialitetit, si n\u00eb rastin e hetimeve n\u00eb zhvillim e sip\u00ebr, Autoriteti marr\u00ebs duhet t\u00eb informoj\u00eb Autoritetin transferues p\u00ebr komunikimin e m\u00ebtejsh\u00ebm sa m\u00eb shpejt q\u00eb t\u00eb jet\u00eb e mundur. N\u00eb rastet e sip\u00ebrp\u00ebrmendura, autoriteti transferues duhet t\u00eb mbaj\u00eb sh\u00ebnim p\u00ebr njoftimet n\u00eb fjal\u00eb dhe t\u2019ia komunikoj\u00eb ato Autoritetit Mbik\u00ebqyr\u00ebs me k\u00ebrkes\u00ebn e tij. Autoriteti marr\u00ebs do t\u00eb p\u00ebrpiqet t\u00eb siguroj\u00eb q\u00eb t\u00eb p\u00ebrmbahet komunikimi i m\u00ebtejsh\u00ebm, pa autorizim paraprak, i t\u00eb dh\u00ebnave personale t\u00eb marra n\u00eb p\u00ebrputhje me k\u00ebto klauzola,. N\u00eb m\u00ebnyr\u00eb t\u00eb ve\u00e7ant\u00eb duke zbatuar t\u00eb gjitha p\u00ebrjashtimet dhe kufizimet e zbatueshme.<\/p>\n\n\n\n<p><em>6.2 Transferimi i m\u00ebtejsh\u00ebm i t\u00eb dh\u00ebnave personale<\/em><\/p>\n\n\n\n<p>Nj\u00eb Autoritet marr\u00ebs mund t\u00eb vazhdoj\u00eb me transferimin e m\u00ebtejsh\u00ebm t\u00eb t\u00eb dh\u00ebnave personale t\u00eb nj\u00eb Autoriteti tjet\u00ebr i nj\u00eb vendi t\u00eb tret\u00eb ose nj\u00eb organizat\u00eb nd\u00ebrkomb\u00ebtare, vet\u00ebm me autorizimin me shkrim t\u00eb Autoritetit transferues dhe me kusht q\u00eb vendi i tret\u00eb ose organizata nd\u00ebrkomb\u00ebtare t\u00eb siguroj\u00eb t\u00eb nj\u00ebjtat garanci q\u00eb parashikohet n\u00eb klauzolat e sip\u00ebrp\u00ebrmendura.
