Kjo rregullore luan nj\u00eb rol kritik n\u00eb sigurimin e integritetit financiar dhe parandalimin e aktiviteteve t\u00eb paligjshme si pastrimi i parave, pasi zyrat e k\u00ebmbimit shpesh konsiderohen nj\u00eb hallk\u00eb e ndjeshme n\u00eb k\u00ebt\u00eb aspekt. Banka e Shqip\u00ebris\u00eb, si autoriteti mbik\u00ebqyr\u00ebs, e miratoi rregulloren fillestare n\u00eb vitin 2007, dhe prej at\u00ebher\u00eb e ka forcuar at\u00eb me ndryshime periodike p\u00ebr t\u2019iu p\u00ebrgjigjur standardeve gjithnj\u00eb e m\u00eb rigoroze nd\u00ebrkomb\u00ebtare. Ve\u00e7an\u00ebrisht, ndryshimet m\u00eb t\u00eb fundit (shtator 2025) synojn\u00eb forcimin e m\u00ebtejsh\u00ebm t\u00eb k\u00ebrkesave rregullative, n\u00eb p\u00ebrputhje me rekomandimet e Moneyval p\u00ebr parandalimin e pastrimit t\u00eb parave dhe financimit t\u00eb <a href=\"https:\/\/www.bankofalbania.org\/Shtypi\/Njoftimet_per_shtyp\/Vendimmarrja_e_Keshillit_Mbikeqyres_ne_mbledhjen_e_dates_3_shtator_2025.html#:~:text=Ndryshimet%20e%20propozuara%20n%C3%AB%20rregullore,parave%20dhe%20financimit%20t%C3%AB%20terrorizmit\" target=\"_blank\" rel=\"noreferrer noopener\">terrorizmit<\/a>. K\u00ebto ndryshime pritet t\u00eb ndikojn\u00eb ndjesh\u00ebm m\u00ebnyr\u00ebn se si operojn\u00eb pikat e k\u00ebmbimit valutor dhe t\u00eb rrisin transparenc\u00ebn e aktivitetit t\u00eb tyre.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rregullorja origjinale e 2007-\u00ebs: \u00e7far\u00eb parashikonte?<\/h2>\n\n\n\n<p>Rregullorja fillestare u miratua nga K\u00ebshilli Mbik\u00ebqyr\u00ebs i Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb me vendimin nr. 31, dat\u00eb <a href=\"https:\/\/www.bankofalbania.org\/rc\/doc\/Nr_31_date_06_06_2007_Per_licencimin_e_zyrave_te_kembimit_valutor_e_n_15055.pdf#:~:text=______%20Miratuar%20me%20vendimin%20nr,Kreu%20I\" target=\"_blank\" rel=\"noreferrer noopener\">06.06.2007<\/a> . Ajo vendoste korniz\u00ebn baz\u00eb p\u00ebr licencimin dhe kontrollin e zyrave valutore, duke p\u00ebrcaktuar kriteret minimale q\u00eb duhej t\u00eb plot\u00ebsonin subjektet e interesuara. Disa pika kryesore t\u00eb versionit origjinal p\u00ebrfshinin:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Kapitali fillestar minimal<\/strong><\/h3>\n\n\n\n<p>K\u00ebrkohej nj\u00eb kapital minimal p\u00ebr licencim. Sipas rregullores (dhe p\u00ebrdit\u00ebsimeve t\u00eb m\u00ebvonshme), ky prag ishte\u00a02.5 milion\u00eb lek\u00eb\u00a0(ose kund\u00ebrvlera n\u00eb valut\u00eb). Kjo shum\u00eb duhej depozituar n\u00eb nj\u00eb bank\u00eb dhe garantonte se subjekti kishte baz\u00eb financiare p\u00ebr t\u00eb kryer veprimtarin\u00eb.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Procedurat e licencimit dhe organizimit<\/strong><\/h3>\n\n\n\n<p>Subjektet duhet t\u00eb aplikonin pran\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb p\u00ebr licenc\u00eb, duke paraqitur dokumentacionin e k\u00ebrkuar. Rregullorja sanksiononte kriteret e struktur\u00ebs pron\u00ebsore dhe menaxhuese (p.sh. k\u00ebrkesa p\u00ebr reputacion t\u00eb mir\u00eb t\u00eb administratorit dhe zot\u00ebruesve), edhe pse n\u00eb at\u00eb koh\u00eb koncepti i\u00a0pronar\u00ebve p\u00ebrfitues\u00a0(beneficial owners) ende nuk p\u00ebrmendej shprehimisht.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Kufizimet e veprimtaris\u00eb<\/strong><\/h3>\n\n\n\n<p>Rregullorja p\u00ebrcaktonte se zyrat valutore lejohet t\u00eb kryejn\u00eb vet\u00ebm veprimtarin\u00eb e k\u00ebmbimit valutor dhe aktivitete t\u00eb lidhura me t\u00eb, duke ndaluar p\u00ebrfshirjen n\u00eb veprimtari t\u00eb tjera financiare pa licenc\u00eb. Gjithashtu, ato duhet t\u00eb respektonin k\u00ebrkesat kund\u00ebr pastrimit t\u00eb parave sipas ligjeve n\u00eb fuqi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Mbik\u00ebqyrja dhe nd\u00ebshkimet<\/strong><\/h3>\n\n\n\n<p>Banka e Shqip\u00ebris\u00eb kishte (dhe vazhdon t\u00eb ket\u00eb) t\u00eb drejt\u00ebn t\u00eb inspektoj\u00eb k\u00ebto zyra dhe t\u00eb vendos\u00eb masa disiplinore n\u00eb rast shkeljesh. N\u00eb versionin origjinal, gjobat administrative p\u00ebr shkelje varionin\u00a0nga 20 mij\u00eb deri n\u00eb 100 mij\u00eb lek\u00eb. Po ashtu, n\u00eb raste serioze (p.sh. dyshime t\u00eb bazuara p\u00ebr p\u00ebrfshirje n\u00eb pastrim parash), rregullorja e vjet\u00ebr lejonte\u00a0pezullimin e licenc\u00ebs deri n\u00eb 60 dit\u00eb\u00a0si mas\u00eb paraprake. Pas k\u00ebtij afati, subjekti ose rifillonte aktivitetin (n\u00ebse pastrohej nga dyshimet), ose i revokohej licenca.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>N\u00eb p\u00ebrgjith\u00ebsi, rregullorja e vitit 2007 vendosi themelet e kontrollit mbi k\u00ebt\u00eb sektor, duke k\u00ebrkuar q\u00eb \u00e7do zyr\u00eb k\u00ebmbimi valutor t\u00eb jet\u00eb e licencuar, t\u00eb ket\u00eb kapital t\u00eb mjaftuesh\u00ebm, drejtues me reputacion dhe t\u00eb respektoj\u00eb ligjet p\u00ebr parandalimin e pastrimit t\u00eb parave. Gjat\u00eb viteve, Banka e Shqip\u00ebris\u00eb ka b\u00ebr\u00eb disa ndryshime t\u00eb pjesshme (n\u00eb 2007, 2011, 2014, 2016, 2019) p\u00ebr ta p\u00ebrshtatur rregulloren me ligjet dhe direktivat e reja. Megjithat\u00eb, paketa e\u00a0ndryshimeve t\u00eb miratuara n\u00eb shtator 2025\u00a0p\u00ebrb\u00ebn p\u00ebrmir\u00ebsimin m\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm deri m\u00eb sot, duke adresuar drejtp\u00ebrdrejt sfidat aktuale t\u00eb tregut dhe k\u00ebrkesat nd\u00ebrkomb\u00ebtare.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Ndryshimet kryesore t\u00eb miratuara n\u00eb vitin 2025<\/h2>\n\n\n\n<p>M\u00eb 3 shtator 2025, K\u00ebshilli Mbik\u00ebqyr\u00ebs i Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb miratoi vendimin nr. 42, dat\u00eb 3.9.2025, i cili solli nj\u00eb s\u00ebr\u00eb ndryshimesh rr\u00ebnj\u00ebsore n\u00eb rregulloren ekzistuese. K\u00ebto ndryshime synojn\u00eb p\u00ebrmir\u00ebsimin e procesit t\u00eb licencimit dhe mbik\u00ebqyrjes s\u00eb zyrave valutore, duke forcuar k\u00ebrkesat p\u00ebr reputacionin, integritetin dhe q\u00ebndrueshm\u00ebrin\u00eb financiare t\u00eb subjekteve, n\u00eb harmoni me standardet nd\u00ebrkomb\u00ebtare p\u00ebr luft\u00ebn kund\u00ebr pastrimit t\u00eb parave. M\u00eb posht\u00eb jan\u00eb pikat kryesore t\u00eb k\u00ebtyre ndryshimeve, t\u00eb ilustruara me shembuj konkret\u00eb:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dyfishimi i kapitalit minimal dhe transparenca e burimit t\u00eb fondeve<\/strong><\/h3>\n\n\n\n<p>Kapitali fillestar minimal i nevojsh\u00ebm p\u00ebr t\u00eb marr\u00eb licenc\u00eb \u00ebsht\u00eb\u00a0rritur nga 2.5 milion\u00eb lek\u00eb n\u00eb 5 milion\u00eb lek\u00eb. Ky dyfishim synon t\u00eb siguroj\u00eb q\u00eb vet\u00ebm subjektet financiarisht m\u00eb t\u00eb q\u00ebndrueshme t\u00eb operojn\u00eb n\u00eb treg. P\u00ebr m\u00eb tep\u00ebr, rregullorja e re k\u00ebrkon q\u00eb\u00a0\u00e7do pages\u00eb e kapitalit\u00a0(fillestar apo shtes\u00eb) t\u00eb shoq\u00ebrohet me dokumentacion mbi\u00a0origjin\u00ebn e fondeve. Aplikant\u00ebt p\u00ebr licenc\u00eb duhet t\u00eb justifikojn\u00eb burimin e kapitalit t\u00eb investuar, duke p\u00ebrfshir\u00eb edhe nj\u00eb deklarat\u00eb noteriale q\u00eb v\u00ebrteton se kapitali nuk \u00ebsht\u00eb i huazuar. Banka e Shqip\u00ebris\u00eb ka tani t\u00eb drejt\u00eb t\u00eb k\u00ebrkoj\u00eb sqarime shtes\u00eb dhe t\u00eb verifikoj\u00eb n\u00eb detaje burimin e parave q\u00eb do t\u00eb p\u00ebrdoren si kapital i zyr\u00ebs s\u00eb k\u00ebmbimit. K\u00ebto k\u00ebrkesa shtes\u00eb rrisin transparenc\u00ebn financiare dhe pengojn\u00eb futjen e parave me origjin\u00eb t\u00eb dyshimt\u00eb n\u00eb k\u00ebt\u00eb aktivitet.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>P\u00ebrfshirja e pronar\u00ebve p\u00ebrfitues dhe kritere m\u00eb t\u00eb rrepta \u201cFit &amp; Proper\u201d<\/strong><\/h3>\n\n\n\n<p>Nj\u00eb risi e r\u00ebnd\u00ebsishme \u00ebsht\u00eb\u00a0futja e konceptit t\u00eb \u201cpronar\u00ebve p\u00ebrfitues\u201d\u00a0(beneficial owners) n\u00eb rregullore. Tashm\u00eb, gjat\u00eb procesit t\u00eb licencimit, subjektet duhet t\u00eb\u00a0identifikojn\u00eb dhe deklarojn\u00eb pronar\u00ebt e tyre p\u00ebrfitues\u00a0(personat q\u00eb zot\u00ebrojn\u00eb ose kontrollojn\u00eb realisht kompanin\u00eb) K\u00ebta pronar\u00eb p\u00ebrfitues, ashtu si aksioner\u00ebt\/ortak\u00ebt dhe administrator\u00ebt, i n\u00ebnshtrohen vler\u00ebsimit t\u00eb p\u00ebrshtatshm\u00ebris\u00eb dhe integritetit nga Banka e Shqip\u00ebris\u00eb. Sipas ndryshimeve,\u00a0reputacioni i mir\u00eb, integriteti profesional dhe financiar\u00a0i \u00e7do pronari p\u00ebrfitues apo drejtuesi b\u00ebhen kusht i qart\u00eb p\u00ebr miratimin e licenc\u00ebs Banka do t\u00eb vler\u00ebsoj\u00eb k\u00ebto elemente si n\u00eb momentin e dh\u00ebnies s\u00eb licenc\u00ebs, ashtu edhe sa her\u00eb q\u00eb t\u00eb ket\u00eb ndryshime n\u00eb struktur\u00ebn e pron\u00ebsis\u00eb apo organet drejtuese gjat\u00eb aktivitetit. Kjo n\u00ebnkupton q\u00eb, p.sh., n\u00ebse nj\u00eb zyr\u00eb k\u00ebmbimi shitet apo kalon tek pronar\u00eb t\u00eb rinj, k\u00ebta t\u00eb fundit do t\u00eb kalojn\u00eb n\u00eb filt\u00ebr t\u00eb rrept\u00eb p\u00ebr t\u00eb garantuar se kan\u00eb integritet t\u00eb lart\u00eb dhe nuk jan\u00eb t\u00eb implikuar n\u00eb veprimtari t\u00eb paligjshme. P\u00ebrkufizimi i \u201creputacionit t\u00eb mir\u00eb\u201d formalizohet n\u00eb rregullore: individi nuk duhet t\u00eb ket\u00eb rekorde kriminale (sidomos p\u00ebr krime financiare), duhet t\u00eb ket\u00eb etik\u00eb profesionale dhe gjendje t\u00eb mir\u00eb financiare, dhe t\u00eb mos jet\u00eb subjekt hetimesh apo sanksionesh n\u00eb kund\u00ebrshtim me ligjin. K\u00ebto standarde \u201cfit &amp; proper\u201d t\u00eb shtuara pritet t\u00eb rrisin ndjesh\u00ebm filtrimin e subjekteve dhe personave t\u00eb lidhur me to, duke larguar nga tregu individ\u00ebt e dyshimt\u00eb.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>K\u00ebrkesa t\u00eb reja p\u00ebr administrator\u00ebt dhe raportimin<\/strong><\/h3>\n\n\n\n<p>Rregullorja e re vendos standarde m\u00eb t\u00eb larta edhe p\u00ebr stafin drejtues t\u00eb zyrave valutore.\u00a0Administratori\u00a0i nj\u00eb zyre k\u00ebmbimi tani duhet t\u00eb ket\u00eb\u00a0arsim t\u00eb lart\u00eb \u2013 minimumi diplom\u00eb master ose ekuivalent\u00a0n\u00eb nj\u00eb fush\u00eb t\u00eb p\u00ebrshtatshme. Ky kriter arsimor formal nuk ishte p\u00ebrcaktuar qart\u00eb m\u00eb par\u00eb dhe synon t\u00eb siguroj\u00eb se drejtimi i subjekteve u besohet personave me kualifikim profesional. Po ashtu, verifikimi i\u00a0reputacionit t\u00eb mir\u00eb\u00a0t\u00eb administratorit b\u00ebhet kusht p\u00ebr miratimin e licenc\u00ebs, n\u00eb m\u00ebnyr\u00eb t\u00eb ngjashme me at\u00eb t\u00eb pronar\u00ebve. N\u00eb aspektin e\u00a0raportimit, rregullorja e re parashikon p\u00ebrdorimin e sistemit elektronik\u00a0ERRS (Sistemi Elektronik i Raportimit Rregullator)\u00a0p\u00ebr t\u00eb dor\u00ebzuar raportet periodike. Kjo pritet t\u00eb standardizoj\u00eb dhe leht\u00ebsoj\u00eb shk\u00ebmbimin e t\u00eb dh\u00ebnave midis zyrave t\u00eb k\u00ebmbimit dhe Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb. Gjithashtu, Banka do t\u00eb ket\u00eb bashk\u00ebpunim m\u00eb t\u00eb ngusht\u00eb me\u00a0Agjencin\u00eb e Inteligjenc\u00ebs Financiare (FIU)\u00a0gjat\u00eb shqyrtimit t\u00eb aplikimeve p\u00ebr licenc\u00eb dhe monitorimit t\u00eb veprimtaris\u00eb. P\u00ebrfshirja e FIU-s\u00eb \u2013 e cila merret me analiz\u00ebn e transaksioneve t\u00eb dyshimta \u2013 siguron q\u00eb aspektet e parandalimit t\u00eb pastrimit t\u00eb parave t\u00eb jen\u00eb n\u00eb fokus q\u00eb n\u00eb momentin e licencimit t\u00eb nj\u00eb subjekt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Kufizime t\u00eb reja p\u00ebr transaksionet me para fizike (cash)<\/strong><\/h3>\n\n\n\n<p>Nj\u00eb nga ndryshimet m\u00eb t\u00eb komentuara \u00ebsht\u00eb vendosja e\u00a0kufijve zyrtar\u00eb\u00a0mbi shum\u00ebn e parave fizike q\u00eb mund t\u00eb shk\u00ebmbehen apo mbahen nga zyrat valutore.\u00a0\u00c7do transaksion mbi 1,000,000 lek\u00eb\u00a0(rreth 10 mij\u00eb USD, ose ~8,500 euro)\u00a0nuk lejohet t\u00eb kryhet drejtp\u00ebrdrejt n\u00eb cash. N\u00ebse nj\u00eb klient k\u00ebrkon t\u00eb shk\u00ebmbej\u00eb nj\u00eb shum\u00eb m\u00eb t\u00eb madhe se ky prag, transaksioni\u00a0duhet t\u00eb kryhet p\u00ebrmes llogarive bankare ose instrumenteve t\u00eb tjera t\u00eb pages\u00ebs\u00a0dhe jo thjesht duke dor\u00ebzuar para fizike tek sporteli. Ky kufizim synon t\u00eb frenoj\u00eb qarkullimin informal t\u00eb sasive t\u00eb m\u00ebdha cash dhe t\u00eb shtyj\u00eb k\u00ebto shk\u00ebmbime drejt kanaleve bankare, ku lihen gjurm\u00eb dhe mund\u00ebsohet kontroll m\u00eb i mir\u00eb (p.sh. verifikimi i identitetit t\u00eb klientit, raportimi i dyshimeve, etj.). Po ashtu, rregullorja detyron q\u00eb\u00a0zyrat e k\u00ebmbimit t\u00eb mos mbajn\u00eb n\u00eb ark\u00ebn e tyre ditore m\u00eb shum\u00eb para cash sesa \u00ebsht\u00eb niveli i kapitalit fillestar t\u00eb tyre. Kjo do t\u00eb thot\u00eb se, me kapitalin e ri minimal prej 5 milion\u00eb lek\u00ebsh, nj\u00eb zyr\u00eb k\u00ebmbimi nuk mund t\u00eb mbaj\u00eb fizikisht n\u00eb ambientet e saj m\u00eb shum\u00eb se 5 milion\u00eb lek\u00eb cash n\u00eb fund t\u00eb dit\u00ebs. Kjo mas\u00eb kufizon stokun e paras\u00eb q\u00eb qarkullon jasht\u00eb bankave dhe ul rrezikun e abuzimeve ose aktiviteteve informale brenda dit\u00ebs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Masa nd\u00ebshkimore m\u00eb t\u00eb ashpra<\/strong><\/h3>\n\n\n\n<p>P\u00ebr t\u00eb siguruar zbatimin e rregullave t\u00eb reja, Banka e Shqip\u00ebris\u00eb ka rritur ndjesh\u00ebm sanksionet ndaj subjekteve q\u00eb i shkelin ato.\u00a0Gjobat maksimale\u00a0administrative jan\u00eb rritur\u00a0nga 100 mij\u00eb lek\u00eb n\u00eb 1 milion lek\u00eb, pra dhjet\u00ebfishim i kufirit maksimal. N\u00eb t\u00eb shkuar\u00ebn, gjobat p\u00ebr shkelje (p\u00ebr subjektin apo administratorin) varionin nga 20,000 lek\u00eb minimalja deri n\u00eb 100,000 lek\u00eb maksimalja; tani, p\u00ebr shkelje serioze, nj\u00eb zyr\u00eb mund t\u00eb nd\u00ebshkohet me gjob\u00eb shum\u00eb m\u00eb t\u00eb r\u00ebnd\u00eb, q\u00eb reflekton natyr\u00ebn kritike t\u00eb detyrimeve t\u00eb reja. Nj\u00eb ndryshim tjet\u00ebr dometh\u00ebn\u00ebs lidhet me\u00a0pezullimin e licenc\u00ebs: m\u00eb her\u00ebt, n\u00ebse kishte prova t\u00eb besueshme q\u00eb nj\u00eb subjekt ishte p\u00ebrfshir\u00eb n\u00eb pastrim parash\/financim terrorizmi, Banka pezullonte licenc\u00ebn p\u00ebr deri 60 dit\u00eb\u00a0Tani ky afat \u00ebsht\u00eb zgjatur\u00a0\u2013 rregullorja e re parashikon pezullim deri n\u00eb\u00a090 dit\u00eb (3 muaj), me\u00a0ndalim t\u00eb plot\u00eb t\u00eb aktivitetit\u00a0gjat\u00eb asaj periudhe. Kjo i jep Bank\u00ebs m\u00eb shum\u00eb hap\u00ebsir\u00eb kohore p\u00ebr hetime ose procedura ligjore, dhe ushton presion mbi subjektin p\u00ebr t\u00eb adresuar shpejt shkeljet; n\u00eb raste t\u00eb r\u00ebnda, pezullimi mund t\u00eb pasohet me revokim licence. P\u00ebr m\u00eb tep\u00ebr, subjekteve q\u00eb\u00a0nd\u00ebrpresin vullnetarisht aktivitetin\u00a0p\u00ebr nj\u00eb periudh\u00eb 1\u20133 muaj u k\u00ebrkohet tani\u00a0t\u00eb njoftojn\u00eb zyrtarisht Bank\u00ebn\u00a0dhe t\u00eb ndjekin nj\u00eb procedur\u00eb t\u00eb ve\u00e7ant\u00eb dokumentimi gjat\u00eb pezullimit t\u00eb p\u00ebrkohsh\u00ebm. Zbatimi i k\u00ebtyre k\u00ebrkesave mund t\u00eb sjell\u00eb edhe\u00a0kosto shtes\u00eb administrative\u00a0p\u00ebr zyrat e k\u00ebmbimit (p.sh. marrja e v\u00ebrtetimeve noteriale, dokumenteve t\u00eb pron\u00ebsis\u00eb, certifikatave t\u00eb gjendjes gjyq\u00ebsore p\u00ebr administrator\u00ebt\/pronar\u00ebt, etj.), por n\u00eb k\u00ebmbim sektori do t\u00eb b\u00ebhet m\u00eb i\u00a0formalizuar dhe i besuesh\u00ebm\u00a0p\u00ebr publikun dhe investitor\u00ebt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Kufizimet e cash-it: efektet n\u00eb operacionet ditore<\/strong><\/h3>\n\n\n\n<p>Vendosja e tavanit prej 1 milion lek\u00ebsh p\u00ebr transaksionet cash do t\u00eb\u00a0ndryshoj\u00eb sjelljen e klientel\u00ebs\u00a0dhe operacionet e p\u00ebrditshme t\u00eb k\u00ebmbimit. P\u00ebr shumica e transaksioneve t\u00eb vogla dhe mesatare (p.sh. nj\u00eb qytetar q\u00eb k\u00ebmben disa qindra euro), nuk pritet ndikim, pasi ato zakonisht jan\u00eb n\u00ebn kufi. Por p\u00ebr transaksionet e m\u00ebdha \u2013 shpesh t\u00eb kryera nga bizneset ose individ\u00eb me sasi t\u00eb konsiderueshme valute \u2013 do t\u00eb k\u00ebrkohet\u00a0angazhimi i bankave. K\u00ebshtu, nj\u00eb kompani q\u00eb do t\u00eb konvertoj\u00eb, fjala vjen, 15 mij\u00eb euro n\u00eb lek\u00eb, tani do t\u00eb duhet ta b\u00ebj\u00eb k\u00ebt\u00eb duke p\u00ebrdorur llogarin\u00eb bankare (d.m.th. t\u00eb d\u00ebrgoj\u00eb ose marr\u00eb fondet n\u00ebp\u00ebrmjet bank\u00ebs) n\u00eb vend q\u00eb thjesht t\u00eb paraqitet me para n\u00eb dor\u00eb te kambisti. Kjo politik\u00eb pritet t\u00eb\u00a0rris\u00eb gjurmueshm\u00ebrin\u00eb\u00a0e transaksioneve t\u00eb m\u00ebdha dhe t\u00eb zvog\u00ebloj\u00eb volumin e paras\u00eb fizike q\u00eb qarkullon jasht\u00eb sistemit bankar. Edhe vet\u00eb zyrat e k\u00ebmbimit do t\u00eb duhet t\u00eb menaxhojn\u00eb me kujdes ark\u00ebn e tyre ditore, pasi tejkalimi i limitit (kapitalit) mund t\u2019u kushtoj\u00eb shtrenjt\u00eb \u2013 duke i ekspozuar ndaj nd\u00ebshkimeve. Ndon\u00ebse disa operator\u00eb mund ta shohin k\u00ebt\u00eb si kufizim i biznesit, n\u00eb plan afatgjat\u00eb ul\u00a0rrezikun e grabitjeve\u00a0apo humbjeve (pasi mban m\u00eb pak cash n\u00eb dor\u00eb) dhe i detyron t\u00eb\u00a0forcojn\u00eb lidhjet me bankat\u00a0p\u00ebr likuiditetin ditor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Forcimi i kultur\u00ebs s\u00eb pajtueshm\u00ebris\u00eb (compliance)<\/strong><\/h3>\n\n\n\n<p>Me rritjen e gjobave dhe mund\u00ebsin\u00eb e pezullimit m\u00eb t\u00eb gjat\u00eb apo edhe pa afat t\u00eb licenc\u00ebs, zyrat e k\u00ebmbimit do t\u00eb jen\u00eb m\u00eb t\u00eb kujdesshme n\u00eb respektimin e kuadrit ligjor. Mund t\u00eb parashikojm\u00eb se n\u00eb t\u00eb ardhmen do t\u00eb ket\u00eb edhe masa t\u00eb tjera p\u00ebr t\u00eb integruar sektorin e zyrave valutore me platformat dixhitale dhe ndoshta p\u00ebr t\u2019i inkurajuar ato t\u00eb ofrojn\u00eb sh\u00ebrbime t\u00eb tilla n\u00eb m\u00ebnyr\u00eb t\u00eb autorizuar.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Rritja e standardeve t\u00eb kontrollit<\/strong><\/h3>\n\n\n\n<p>Duke qen\u00eb se zyrat e k\u00ebmbimit valutor do t\u00eb monitorohen m\u00eb nga af\u00ebr (bashk\u00ebpunimi me FIU, raportimi elektronik, inspektime m\u00eb t\u00eb shpeshta t\u00eb mundshme), pritet nj\u00eb\u00a0rritje e kapaciteteve mbik\u00ebqyr\u00ebse\u00a0t\u00eb vet\u00eb Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb. Duke krahasuar tekstin origjinal t\u00eb 2007-\u00ebs me versionin e ndryshuar t\u00eb 2025-\u00ebs, vihet re nj\u00eb transformim i duksh\u00ebm nga nj\u00eb qasje bazike e rregullimit drejt nj\u00eb qasjeje shum\u00eb m\u00eb gjith\u00ebp\u00ebrfshir\u00ebse dhe pro-aktive. Kjo pasqyron evolucionin e prioriteteve: nga thjesht licencimi i aktivitetit n\u00eb vitet 2000, tek sigurimi q\u00eb ky aktivitet t\u00eb zhvillohet nga\u00a0aktor\u00eb t\u00eb p\u00ebrgjegjsh\u00ebm, transparent\u00eb dhe rezistent\u00eb\u00a0ndaj rreziqeve ligjore e financiare n\u00eb dit\u00ebt e sotme.
