P\u00ebr mbi nj\u00eb dekad\u00eb ai ka funksionuar si korniz\u00eb e vetme, por me kalimin e viteve kishte filluar t\u00eb tregonte kufizimet e tij.<\/p>\n\n\n\n<p>Vendimi i 2015-\u00ebs kishte mbuluar bazat, kuptimin e hap\u00ebsir\u00ebs publike, parimet e administrimit dhe disa rregulla t\u00eb p\u00ebrgjithshme. Por nuk kishte parashikuar procedura t\u00eb detajuara sipas kategorive t\u00eb aktivitetit, nuk kishte adresuar strukturat reklamuese moderne si panelet LED ose City Light dhe nuk kishte nd\u00ebrtuar asnj\u00eb lidhje me regjistrat elektronik\u00eb komb\u00ebtar\u00eb. Bashkit\u00eb, duke punuar me k\u00ebt\u00eb korniz\u00eb t\u00eb mang\u00ebt, kishin hartuar rregulloret e tyre vendore, ndonj\u00ebher\u00eb t\u00eb papajtueshme me nj\u00ebra-tjetr\u00ebn.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00c7far\u00eb sjell vendimi i ri<\/h3>\n\n\n\n<p><a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2026\/04\/vendim-2026-04-01-224.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Vendimi i ri<\/a> nd\u00ebrhyn pik\u00ebrisht k\u00ebtu. Ai nuk i z\u00ebvend\u00ebson rregulloret vendore, por vendos standardet minimale komb\u00ebtare mbi t\u00eb cilat \u00e7do bashki duhet t\u00eb nd\u00ebrtoj\u00eb. \u00cbsht\u00eb kuadri ligjor mbi t\u00eb cilin do t\u00eb operoj\u00eb \u00e7do rregullore vendore e re pas k\u00ebtij momenti.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Vendimi \u00ebsht\u00eb miratuar n\u00eb baz\u00eb dhe n\u00eb zbatim t\u00eb Ligjit nr. <a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2026\/04\/vendim-2015-12-28-1096.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">107\/2014 &#8220;P\u00ebr planifikimin dhe zhvillimin e territorit&#8221;<\/a>, i ndryshuar me <a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2022\/10\/ligj-nr.42-date-04.07.2019_per-disa-shtesesa-ne-Ligjin-107_2014-1-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Ligjin nr. 41\/2024<\/a>. Neni 4\/1 i atij ligji kishte caktuar detyrimin e K\u00ebshillit t\u00eb Ministrave p\u00ebr t\u00eb rregulluar me vendim kushtet dhe procedurat e shfryt\u00ebzimit t\u00eb hap\u00ebsirave publike.<\/p>\n<\/blockquote>\n\n\n\n<p>Konteksti \u00ebsht\u00eb i r\u00ebnd\u00ebsish\u00ebm edhe p\u00ebr nj\u00eb arsye tjet\u00ebr. Shqip\u00ebria \u00ebsht\u00eb n\u00eb mes t\u00eb procesit t\u00eb integrimit europian dhe nj\u00ebkoh\u00ebsisht n\u00eb faz\u00eb thellimi t\u00eb reformave t\u00eb decentralizimit. Standardizimi i hap\u00ebsirave publike \u00ebsht\u00eb pjes\u00eb e k\u00ebsaj agjende: transparenc\u00eb, procedura dixhitale dhe kontroll i dokumentuesh\u00ebm. Vendimi i 2026-\u00ebs \u00ebsht\u00eb edhe nj\u00eb hap n\u00eb at\u00eb drejtim.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kush Prek dhe Kush Administron<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Perimetri i zbatimit<\/h3>\n\n\n\n<p>Para se t\u00eb hyjm\u00eb te procedurat dhe kostot, duhet kuptuar qart\u00eb se cili \u00ebsht\u00eb perimetri i vendimit. Jo \u00e7do hap\u00ebsir\u00eb e hapur \u00ebsht\u00eb &#8220;hap\u00ebsir\u00eb publike&#8221; n\u00eb kuptimin e k\u00ebtij akti.<\/p>\n\n\n\n<p>Vendimi zbatohet p\u00ebr hap\u00ebsirat publike n\u00eb pron\u00ebsi shtet\u00ebrore q\u00eb administrohen nga nj\u00ebsit\u00eb e qeverisjes vendore, si dhe p\u00ebr hap\u00ebsirat n\u00eb pron\u00ebsi t\u00eb institucioneve publike qendrore. Ai zbatohet edhe p\u00ebr hap\u00ebsirat private t\u00eb aksesueshme publikisht, kur ato mir\u00ebmbahen apo administrohen me burime publike. Trotuaret, sheshet, parqet, bregdetet dhe rrug\u00ebt jan\u00eb shembujt tipik\u00eb.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kompetenca administrative<\/h3>\n\n\n\n<p>Autoriteti kryesor administrativ \u00ebsht\u00eb kryetari i bashkis\u00eb, i cili miraton lejet deri n\u00eb nj\u00eb vit. Lejet me afat mbi nj\u00eb vit, por jo mbi pes\u00eb vjet, miratohen nga K\u00ebshilli Bashkiak. Kjo ndarje kompetencash nuk \u00ebsht\u00eb e rast\u00ebsishme: leja afatshkurt\u00ebr mbulon nevojat sezonale dhe vjetore t\u00eb aktivitetit tregtar, nd\u00ebrsa leja afatgjat\u00eb k\u00ebrkon angazhim institucional t\u00eb nj\u00eb organi kolegjial.<\/p>\n\n\n\n<p>Shkeljet administrative trajtohen sipas Ligjit nr.<a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2026\/04\/ligj-2014-07-31-107.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> 107\/2014 &#8220;P\u00ebr planifikimin dhe zhvillimin e territorit&#8221;<\/a> dhe Ligjit <a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2026\/04\/ligj-2010-05-20-10279.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">nr. 10 279\/2010 &#8220;P\u00ebr kund\u00ebrvajtjet administrative<\/a>&#8220;. Aplikimi b\u00ebhet n\u00ebp\u00ebrmjet portalit e-Albania.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dokumentacioni i k\u00ebrkuar<\/h3>\n\n\n\n<p>Dokumentacioni baz\u00eb p\u00ebrfshin formularin e aplikimit, planin e vendosjes me gjendjen ekzistuese dhe at\u00eb t\u00eb propozuar, planimetrin\u00eb e firmosur nga projektues i licencuar, fotografit\u00eb e gjendjes aktuale, vizualizimet grafike t\u00eb projektit, dokumentin e pron\u00ebsis\u00eb ose kontrat\u00ebn e qiras\u00eb, NIPT-in e subjektit dhe v\u00ebrtetimin e shlyerjes s\u00eb detyrimeve tatimore.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fazat dhe afatet<\/h3>\n\n\n\n<p>Procedura zhvillohet n\u00eb dy faza. Brenda shtat\u00eb dit\u00ebve kalendarike nga dor\u00ebzimi, bashkia kontrollon dokumentacionin dhe njofton p\u00ebr \u00e7do mang\u00ebsi. Pas dor\u00ebzimit t\u00eb dosjes s\u00eb plot\u00eb, vendimi final merret brenda pes\u00ebmb\u00ebdhjet\u00eb dit\u00ebve kalendarike. Pasi leja miratohet, bashkia l\u00ebshon dokumentin zyrtar me t\u00eb cilin subjekti paguan tarif\u00ebn.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kushtet e lejes<\/h3>\n\n\n\n<p>Leja \u00ebsht\u00eb personale dhe e patransferueshme. Nuk mund t&#8217;i kaloj\u00eb nj\u00eb subjekti tjet\u00ebr, as n\u00ebse ai subjekt lidhet pron\u00ebsisht me titullarin. Ajo duhet afishuar n\u00eb nj\u00eb vend t\u00eb duksh\u00ebm p\u00ebr publikun, bashk\u00eb me planin e vendosjes t\u00eb miratuar. Mospajisja me leje ose tejkalimi i kushteve t\u00eb saj ka pasoja t\u00eb dokumentuara: gjob\u00eb, pezullim i aktivitetit dhe ndalim riaplikimi deri n\u00eb dy vjet.<\/p>\n\n\n\n<p>Leja ka afat maksimal nj\u00ebvje\u00e7ar p\u00ebr lejet e zakonshme dhe mund t\u00eb jet\u00eb sezonale, por jo m\u00eb e shkurt\u00ebr se tre muaj. Rinovimi nuk \u00ebsht\u00eb automatik dhe k\u00ebrkohet t\u00eb pakt\u00ebn tre muaj para skadimit t\u00eb lejes ekzistuese, pas verifikimit t\u00eb pajtueshm\u00ebris\u00eb me kushtet e m\u00ebparshme dhe shlyerjes s\u00eb t\u00eb gjitha detyrimeve.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sa Kushton: Tarifa e Z\u00ebnies dhe Lidhja me Taksat e Tjera Vendore<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Si llogaritet tarifa<\/h3>\n\n\n\n<p>Tarifa e z\u00ebnies s\u00eb hap\u00ebsir\u00ebs publike \u00ebsht\u00eb taks\u00eb vendore e parashikuar n\u00eb <a href=\"https:\/\/alprofitconsult.al\/wp-content\/uploads\/2022\/01\/Ligj-Nr-9632-date-30.10.2006-Per-sistemin-e-taksave-vendore-i-ndryshuar.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Ligjin nr. 9632, dat\u00eb 30 tetor 2006 &#8220;P\u00ebr sistemin e taksave vendore&#8221;, i ndryshuar.<\/a> Ky ligj p\u00ebrcakton korniz\u00ebn komb\u00ebtare, por nivelin konkret e vendos \u00e7do K\u00ebshill Bashkiak me vendim t\u00eb ve\u00e7ant\u00eb vjetor. Kjo do t\u00eb thot\u00eb se tarifa ndryshon nga bashkia n\u00eb bashki dhe, brenda asaj bashkie, nga zona n\u00eb zon\u00eb.<\/p>\n\n\n\n<p>Parametrat mbi baz\u00ebn e t\u00eb cil\u00ebve llogaritet tarifa jan\u00eb tre. I pari \u00ebsht\u00eb sip\u00ebrfaqja e z\u00ebn\u00eb, e shprehur n\u00eb metra katror\u00eb. I dyti \u00ebsht\u00eb zona e qytetit, pasi qendrat tregtare paguajn\u00eb tarifa m\u00eb t\u00eb larta se zonat periferike. I treti \u00ebsht\u00eb natyra dhe koh\u00ebzgjatja e aktivitetit. Bizneset me afat mbi nj\u00eb vit e rregullojn\u00eb tarif\u00ebn me kontrat\u00eb.<\/p>\n\n\n\n<p>T\u00eb ardhurat nga tarifa destinohen me ligj ekskluzivisht p\u00ebr mir\u00ebmbajtjen, rehabilitimin dhe p\u00ebrmir\u00ebsimin e hap\u00ebsirave publike. Bashkia detyrohet t\u00eb publikoj\u00eb \u00e7do vit raport mbi shpenzimin e tyre.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Lidhja me taksat e tjera vendore<\/h3>\n\n\n\n<p>Tarifa e z\u00ebnies s\u00eb hap\u00ebsir\u00ebs publike dhe taksa e tabel\u00ebs reklamuese jan\u00eb dy detyrime t\u00eb ndryshme dhe plot\u00ebsuese. Taksa e tabel\u00ebs ekzistonte edhe para k\u00ebtij vendimi dhe mbetet si detyrim autonom i llogaritur mbi sip\u00ebrfaqen dhe llojin e tabel\u00ebs. Biznesi q\u00eb vendos nj\u00eb struktur\u00eb reklamuese fizikisht n\u00eb hap\u00ebsir\u00ebn publike i n\u00ebnshtrohet t\u00eb dyjave nj\u00ebkoh\u00ebsisht. Biznesi q\u00eb ka tabel\u00ebn mbi fasad\u00ebn e objektit t\u00eb vet privat, por ajo fasad\u00eb kufizon hap\u00ebsir\u00ebn publike, ka gjithashtu detyrim leje sipas vendimit t\u00eb ri.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Garancia financiare<\/h3>\n\n\n\n<p>Krahas tarif\u00ebs, disa kategori aktivitetesh detyrohen t\u00eb depozitojn\u00eb garanci financiare para marrjes s\u00eb lejes. Kjo garanci ekzekutohet n\u00ebse subjekti nuk e kthen hap\u00ebsir\u00ebn n\u00eb gjendjen fillestare ose shkakton d\u00ebmtime gjat\u00eb ushtrimit t\u00eb aktivitetit. N\u00ebse leja skadohet ose revokohet, hap\u00ebsira duhet kthyer n\u00eb gjendjen fillestare brenda pes\u00eb dit\u00ebve kalendarike.
