Labor Code and Fundamental Principles

The Labor Code is based on certain universal principles that guarantee equal rights for all individuals in employment relationships. It sets forth the rules for developing sustainable and transparent relationships between employers and employees.

Justice 

Every employment relationship must be based on the respect of mutual rights and responsibilities (Article 1).

Equality

Employers are required to ensure equal conditions for all employees, avoiding any form of discrimination based on gender, race, religious belief, or political conviction (Article 9).

Practical example: A large company that employs people in various positions cannot offer different wages to men and women who perform the same work.

Respect for the Constitution and Link to International Legislation

The Labor Code is closely based on the Constitution of the Republic of Albania, which guarantees equality before the law and the right to fair and honest work (Article 2). It is also harmonized with international conventions such as those of the International Labour Organization (ILO), ensuring that its provisions comply with global standards.

Practical example: An Albanian employee at an international company is entitled to the same vacation and working conditions as employees in the other countries where the company operates.

Hierarchy of Norms and Respect for Custom

In the event of discrepancies between individual contracts and the law, the provisions most favorable to the employee shall prevail. Likewise, in the absence of clear provisions, customs and practices widely accepted in employment relationships shall apply (Article 11).

Practical example: If an employment contract provides for three weeks of annual leave but the law specifies four weeks, the law applies as the more favorable standard.
