Employment Contract

The employment contract is the primary document that defines the relationship between the employer and the employee. It must be in writing and include the following elements:

  1. Party data.
  2. Description of the employee's responsibilities.
  3. Payment and compensation terms.
  4. Work schedule and breaks.
  5. Contract term (Article 12).

Practical example: An employee engaged in a six-month project must have a contract specifying the start and end dates of the employment relationship.

Types of Contracts

The Code defines several types of contracts, including:

  1. Untermain contracts.
  2. Fixed-term contracts for seasonal work.
  3. Part-time contracts, which must proportionally respect labor rights (Article 14).
